The submitter has given permission to the USGenWeb Archives to store the file permanently for free access. http://www.usgwarchives.net **************************************************************************** The following is a transcription of a deed between Augustine Thomas and John Fee of Henry Co, VA: Henry Co, VA, Deed Book 6, pp 254-255 254 Thomas from Fee } Deed This Indenture Made this Eighteenth Day of October one Thousand Eight hundred Between John Fee of Henry County of the one Part & Augustine Thomas of Patrick County of the other part Witnesseth that the said Fee for and in consideration of one hundred pounds to Him in hand paid by said Thomas doth bargain sell & deliver a Certain Tract of Land lying and being in the County aforesaid on the Southside of the South Mayo River containing by Estamtion eighty acres being the same more or less & being part of a Tract of Land of one hundred & ninety five acres formerly the property of William Fee thus bounded Begining at a Locust on the river bank ten or fifteen poles up the river above the wagonford Thence South forty Six degrees West fifty two poles to pointers near the road Thence as the road & with the said road as it runs a west Course to the back Line of the aforesd Tract of land to a post oak thence on and with the sd back Line as it runs a north Course to the Mayo river & to a dog wood near the sd River Bank thence down the said river as it meanders to the beginning & now In the possession of the Sd. Augustine Thomas to Have and Hold the aforesd. Land and premises with the appurtinances therunto belonging or that[?] Is in awise[?] appurtaining unto the aforsd Augustine Thomas his heirs & assigns for ever & the sd John Fee & his Heirs the aforsd. tract of Land & Premises with the appertenances & the Fee Simple right & Title thereof unto the sd. Augustine Thomas his heirs & assigns against him the sd John Fee his Heirs and by the presents warrant & will defend in In Witness whereof the party above named hath hereunto Set his Hand[?] & affixt his Seal the day and date above Written. Teste John Cox CHC ___________ [word written in margin--illegible] Henry Co, VA, Deed Book 6, p 261 261 Thomas from Fee } Dedd[?] The Commonwealth of Virginia To Ballenger Wade & John Dillard Gent, or any two of them Justices of the Peace of Henry County Greeting whereas John Fee by his Certain Indenture of Feofment Hath Conveyed unto Augustine Thomas one Certain Tract or parcel of land Lying and being in the County of Henry containing by Estimation eighty acres, more or less, And whereas Parthena the wife of the said John Fee cannot Travel to and from our said Court of Henry Know ye that we Trusting to your faithfull and provident Circumspection in Examening Parthena the wife of the said John Fee from and apart from her Said husband whether she does freely and voluntarily without the threat or persuations of her said Husband relinquish her right of Dower in and to the said Land and premises Conveyed by her said husband unto the said Augustine Thomas When you have done if[?] that you Certify to our[?] Justices of our said County Court of Henry under your hands and Seals-- Plainly & pertinetly[?] you send together with this writ witness John Cox Clerk of Our said County Court at the Court house the 27th day of October 1800 And in the XXVth year of the Commonwealth John Cox CHC Henry County ___ By virtue of the above didemus to us directed we have Examined Parthena the wife of the said John Fee from and apart from her said Husband touching her relinquishment of Dower in and to the Said land and Premises above mentioned Containing Eighty Acres Conveyed by the said John Fee to the above named Augustine Thomas We do hereby certify that the said Parthena apart from her said husband did freely and voluntarily without the Persuations or threats of her said Husband relinquish her right of Dower in and To the said land and Premisses Conveyed by her sd Husband in the said Indenture unto The Said Augustine Thomas Given under our hands and Seals the 5th day of November 1800 John Dillard S.
