Humbly complaining shew unto your worships your complainants George Hall, James Hall, John Hall, Thomas Hall, Joshua Duggin and Nancy his wife late Nancy Hall, George Dixon and Sally his wife late Sally Hall and James Hall executor of Mary Garner late Mary Hall. That a Certain Elizabeth Gale late of this county departed this life sometime in the year intestate and possessed of a valuable estate in slaves and other personalty. That sometime after her death a certain Alexander Gale qualified as the administrator of the said Elizabeth Gale and declared[?] her estate into possession and Kept the same until the period of his death which took place in this present year whereupon letters of administration de bonis non upon the estate of the said Elizabeth Gale were granted to a certain Andrew Woodley by virtue whereof the said Andrew Woodley hath possessed himself of the said estate and still keeps the same. That the said Elizabeth Gale at the time of her death left no children, neither father, mother, brother, or sister, though she left numerous descendants of her brothers and sisters. The brother and sisters of the whole blood of the said Elizabeth Gale ^ were Thomas Gale, Alice Gale who intermarried with a certain Thomas Amis, Tabitha Gale who intermarried with Jas Hall and who was the mother of your complainants and Nancy Gale who left a child called Abigail Bocock, [page break] [bill of complaint (2 of 4) {image 3 of 30}] and the brother and sister of the half blood of the said Elizabeth Gale were Jethro Gale and Molly Gale who first married a Williams and afterwards a Spencer - The following are the Persons so far as your complaintants have been enabled to ascertain who have descended from the brother and sisters of the whole blood with their degrees of consanguinity. The children of Thomas Gale,- Thomas who is dead Patsy Gale his admix, Joseph Gale, Alexander Gale dead Sally Pope his admix Sally Pope who was Sally Gale, And Fanny Gale who hath intermarried with a certain Robert Gale - The children of Alice Gale wife of Thomas Amis are Tabitha Cox widow, Alice wife of John Gordon, Frances wife of Richard Grantham, Mary wife of Joseph Rogers, Rachel wife of James Hagan Willis Amis, Lincoln Amis and Thomas Amis who is believed to be dead - Nancy Gale left only one child who sold her interest in said estate to F. M. Boykin now dead. And your complaintants are the children and heirs of Tabitha the remaining sister of the whole blood to the said Elizabeth Gale The following are the descendants of Jethro Gale and Molly Gale who first married a Williams and then a Spencer the said Jethro and Molly being a brother and sister of the half blood to the said Elizabeth Gale the children of Jethro.- John Gale who is dead Jethro Gale his admr.- Polly Everitt who hath sold her interest in said estate to the before named Francis M. Boykin now dead. [page break] [bill of complaint (3 of 4) {image 6 of 30}] Elizabeth, wife of William Turner, Nancy Uzzell who hath in open Court relinquished all claim to said estate, Thomas Gale who is dead leaving three infant children Polly Eliza, and Pleasants, Fanny Gale who is dead her Josiah Holliman ^ admr. Esther Gale, and Andrew Gale who hath sold his interest to the said F. M. Boykin. The children of Molly Gale by her first husband Williams was John Williams who is dead leaving two infant children Amelia and Nancy Williams by her second husband Spencer are Mathias Spencer who is dead Wm_ B Bailey his admr. Eliza Spencer, Nancy wife of Byrd Sumner, Peggy who married the above named Thomas Gale who is dead and who was the mother to the above named infant children of Thomas Gale decd. From the above statement it seems that there are twenty one shares of the whole blood and twelve of the half blood exclusive of the interest of Nancy Uzzell who hath relinquis= =hed her interest as before stated. Your complai= nants beg leave further to represent to your worships that a certain Robert Butler hath become the purchaser of the interest of several James Hagan & wife, Willis Amis, John Gordon & wife, Richd. Grantham & wife, Joseph Rogers and wife and Tabitha Cox - of the persons above enumerated ^ and who it mentioned is prayed together with the above ["enumerated" struck] descendants of the brothers and sisters of the said Elizabeth Gale and the before named Andrew Woodley admr d. B N of said and Frances Boykin executrix of Francis M. Boykin herewith present the evidence of their interest in the subject matter of this bill, by which it will appear that the said Robert Butler hath purchased the interest of and Francis M. That the Children of said Thomas Amis and Alice his wife are as follows, to wit, Tabitha Cox widow of John Cox, Frances Grantham wife of Richard Grantham Mary Rogers wife of Joseph Rogers, Rachel Hagan wife of James Hagan Alice Gordon wife of John Gordon, Willis Amis, Lincoln Amis and Thomas Amis, that the said Thomas left this County many Years ago it is not known whether he is living or not. Bailey as admr of Mathias Spencer one half of one 27th part to Eliza Spencer The same to Byrd Sumner and Nancy his wife late Nancy Spencer - Separate bonds with approved security are to be taken from the purchaser or purchasers so as to effect the division of the estate pursuant to the above directions and allotted to the parties respectively or their guardians or agents entitled. ^ And it is ordered that the said Andrew render an a/c to this Court and Woodley ad d b n of E. Gale dec'd do ^ pay over any money in his hands in the same proportions to the above plaintiffs and defendants and to law finally it is ordered that the parties execute refunding bonds to Andrew Woodley ad. as aforesaid according [page break] [p. 3 of 3] * 6 27th parts to Robert Butler who it appears to this Court by the exhibits filed hath purchased the interests of Tabitha Cox. He 2m. a daughter of John MARSHALL, Sr., whose 1760 will mentioned grandchildren Thomas, Ann, Elizabeth, Tabitha & Alice GALE. (WB7:433) Thomas GALE [II] left will 1 Jan 1760, proved 7 Feb 1760, which specified daughter Elizabeth was to receive her legacy only if she did not marry Joshua JENKINS. (Isle of Wight Co. WB6:530) Elizabeth GALE & Francis M. BOYKIN were also legatees in the 1783 will of John MARSHALL, Jr., whose daughter Ann m. Francis BOYKIN. (WB9:232) The 27 shares in this settlement represnt the interests of her nieces and nephews - 21 children of her full siblings, and 12 children of her half siblings.
