    Act of Grand Assembly holden att James Citty y.e 21.th day of Sept.r 1674 
  An act ascerting the Bounds betwixt y.e Countys of Isle of Wight & Nansemond 

Whereas long disputes have arrisen between the Inhabitants of y.e Isle of 
Wight & Nansemond Countys conc'ning y.e deviding lines betwixt y.m 
w.ch disputes have been y.e more P/plext by reason P/tly found in those former 
Acts & Orders of Assembly y.t have seemed to establish y.e line between y.m 
P/ly by from y.e unacquaintance of those heretofore conc'd w.th y.e line 
courses windings & extent of y.e Creeks & Runs, of y.e Lands remote in y.e 
woods from whence it hath come to pass y.t y.e conveniences of both y.e 
Countys could not soe well be discerned nor rightly consulted 
All w.ch this Assembly haveing taken into serious consideraçon, and being 
desirous y.t all disputes & differences about y.e  p'mises may for ever cease 
& determine 
Be it enacted by y.e Gov'n.r Councill & Burgesses of this Grand Assembly & y.e 
authority thereof 
That S:W: & by S Lyne be designed run & plainly m'ked from y.e River side att 
y.e plantaçon [redundant "att y.e plantaçon" struck through] of HAYES 
including that plantaçon to y.e  Isle of Wight extending to y.e  Creek att or 
Near the plantaçon called Nevills Oyster Bank, 
from thence A Line or lines up y.e  Creek to Co.ll PITT's ["Pitts"] Creek 
& soe up y.t Creek to y.e head of y.e s'd Co.ll PITT's ["Pitts"] Land, 
& from thence A, S:W: halfe a point Westerly Indefinitely extended shall be & 
remaine the establisht comon bounds or deviding lyne between y.e s'd Isle of 
Wight and Nansemond Counties 
provided nev'theless that y.e house & cleared ground of Cap.t Thomas GODWYN 
whoe hath been an antient Magistrate of Nansemond County Co.rt be, remaine, 
reputed & deemed in y.e County of Nansemond any thing in y.e intent of this 
Act to y.e  Contrary notw.th standing 
Provided alsoe & it is y.e intent of this Act that nothing herein conteyned 
shall alter y.e P/ishes confining on this deviding Lyne but y.t they remaine 
P/ochiall capacity as they did before y.e marking hereof

Ordered in P/suance of y.e Act of this p'sent Grand Assembly for establishing 
y.e bounds between y.e Counties of Nansimond & Isle of Wight y.t y.e lines 
determined by y.e s'd Act be runn y.e  first Monday in Nov.r by M.r WOODWARD, 
Majo.r MILNER & M.r Arthur ALLEN on their Oaths or any 2 of y.m in p'sence of 
gent.l to be appointed by both Counties, for & in behalfe of their respective 
Counties, and y.t if either of y.e s'd Countys doe fayl to come w.th their 
Surveyo.rs & gent.l to P/forme it att y.e tyme afores'd y.t it be done by 
these or y.m on y.e P/te of y.t County whoe

Shall be p'sent, w.ch shall conclude both Countys; 
that upon runing y.e Lyne it will be discov'ed, to w.ch of these Counties the 
confining families doe belong, 
It is hereby Ordered y.t such pay Levys to y.e County wherein they fall, 
And it is further Ordered that y.e County of Nansemon pay unto M.r Tho: 
WOODWARD & Majo.r Thomas MILNER for w.t they have already done each of y.m 
2000.l' Tob' & Cask, and y.t it be left to each of y.e Counties further to 
gratifie y.e s'd Surveyo.rs for their great paines about w.t hath been done, 
and each County bear its owne charges for enterteinm.t & other matters before 
y.e determinaçon 
And y.t for draweing y.e Lynes & all other charges yett to be expended & 
ascerteined touching y.e finall determinaçon be p'd equaly & in halfes, by 
both Countys
