MORRISON, George MORRISON, Thomas JOINER and Peggy his wife, James ALLMAND and Mary his wife, Elisha UZZEL, and Thomas UZZEL and Morrison UZZEL, infant orphans of Nancy UZZEL by the ["said Elisha" struck through] Thomas UZZEL their ["father &" inserted] next friend. That William MORRISON the father of most of your complainants died about the first day of October A.D. 1802 after having duly made and published his last will and testament in writing. That by his said will, a copy of which is hereto annexed, he devised his mansion plantation to his two sons James MORRISON and Pitt R. MORRISON and their heirs forever, but that if either of them died before attaining the age of twenty one, then the part to which he would have been intitled, to be devided between his two sons William and George MORRISON. That James MORRISON one of the first mentioned legatees, attained the age of twenty one, and died intestate, before any devision was made in the said land. That the said James left four negroes to Wit, Rose, Will, Jacob and Amey. They further Represent that John MORRISON another Son of the said William and themselves are the only persons intitled to the estate of the said James MORRISON, and that a legal devision therein can not be made without the aid of this court on account of the infancy of some of Y.r compl.ts. In tender consideration whereof, and for as much as y.r compl.ts are remediless except by the intervention of this court they pray the interferance of Y.r Worships _ To the end therefore they pray that the said John MORRISON may be made a defendant to this bill of complaint, and that he may full, true and perfect answer make to all and singular the allegations aforesaid, and that as fully as if the same were here repeated and be thereto particularly interrogated, They pray that y.r Worships will decree that the said plantation be devided into two equal parts, and one part thereof to be assigned to Pitt R. MORRISON in conformity to the directions of the will aforesaid, and as the dividend of each heir in the other half will not be worth an hundred dollars, they pray that the court will direct that to be sold as well as the four negroes aforesaid, and the money arising therefrom to be equally devided among the said John MORRISON and themselves, or that your worships will make any [page break] [reverse; bill continues on upper half of page] other or further order or decree for their relief, that may seem just & equitable. May it please &.c The answer of John MORRISON to the bill of complaint exhibited against him in the court of Isle of Wight county, by Pit R. MORRISON, George MORRISON, Thomas JOINER and Peggy his wife, ["Thomas" struck through] James ALLMAND and Mary his wife, Elisha UZZEL, and Thomas UZZEL and Morrison UZZEL, infants by Thomas UZZEL their father and next friend. This Respondent admits that William MORRISON ddi depart this life about the period mentioned in the bill, after having made and published such a will as is therein stated. He admits that a devision in the land agreeable to the said will was not made in the life time of James MORRISON (who attained twenty one years of age before he died). He agrees that the dividend of each heir will not be worth one hundred dollars, and that James MORRISON died intestate. It is also true that James died legally possessed of the four slaves mentioned in the bill, as of his own property. He thereupon joins in praying such a decree as is asked for by the compl.ts and hopes that proper persons will be appointed for executing the same.
