The submitter has given permission to the USGenWeb Archives to store the file permanently for free access. http://www.usgwarchives.net *********************************************************************** Isle of Wight Co., VA, Order Book 1795-1797, pp. 48-49 abstracted by Matt HARRIS [brackets & surname capitalization mine] [p] 48 [At a Court held for Isle of Wight Co., 7 Apr 1795] Mary GIBBS Infant Orphan of John GIBBS decd: with the approbation of the Court made Choice of Elizabeth QUAY for her Guardian who together with Joseph CUTCHIN her Security entered into and Acknowledged their bond in the penalty of two thousand pounds with condition as the law directs for securing the said Orphans estate and indemnifying the Court- Ordered that James JOHNSTON be appointed Surveyor of the road leading from Boykin's Mill to Robert TYNER's in the room of Robert BANADALLS[?] and that the hands as usual attend and keep the same According to law- Nancy JORDAN infant Orphan of John JORDAN decd: with the approbation of the Court made Choice of Thomas JORDAN for her Guardian who together with William WARD her Security entered into and Acknowledged their bond in the panalty of two thousand pounds with Condition as the law directs for securing the said Orphans estate and indemnifying the Court On the motion of Isham JORDAN who made Oath According to law and together with Lewis JORDAN his Security entered into and Acknowledged their bond in the penalty of two thousand pounds with Condition as the law directs Certificate is granted him for obtaining letters of Administration on the estate of David JONES decd: in due form- Frances JONES the Widow and relict of the said David JONES who was left an executrix to his Will refused in Court to take upon her self the burthen of the execution thereof- Ordered that David BENDLEY be appointed Surveyor of the road leading from Fulgham's Mill to the top of the Glebe Hill in the room of William PATTERSON, who has resigned and the hands as usual attend and keep the same in repair According to law:- On the motion of Charles GOODRICH Ordered that William GOODRICH be summoned to appear at the Court to be held for this County in April next, then and there to produce the last Will and testament of Elizabeth GOODRICH decd: to be proved as the law directs:- An Indenture of bargain and Sale between Stephen SMITH and Elizabeth his wife of the one part and James MARTIN of the other part was Acknowledged by the said Stephen SMITH and ordered to be Recorded:- An Indenture of bargain and Sale between Willis SMELLY and Nancy his wife of the one part and James MARTIN of the other part was fully proved by Bennitt YOUNG and Ordered to be Recorded- Ordered that Samuel WHITE, Benjamin WARD, Richard EDWARDS and Charles GOODRICH or any three of them being first sworn before a Justice of the peace for this County appraise in Current Money the Slaves (if any) and personal estate of David JONES decd: and make return thereof to the Court On the motion of Jacob DARDEN, for leave to file a bill of Injunction to stay the proceedings of a Judment at Common law obtained against him by Solomon WILSON Assignee of John Sck. WILLS Administrator of William ROBERTSON decd: for reasons appearing to the Court, leave is given him to file his said bill & to give bond with Security in the Clerk's Office within thirty days from this day- On the motion of Joseph DRIVER, it is ordered that Brewer GODWIN, Peter CUNINGHAM, Nathaneil GRAY, and William WALTHAM or any two of them examine, State, and Settle, an Account Current of the estate of David WILLIAMS decd: and make report thereof to the Court- Ordered that John INGLISH be appointed a Lieutenant of Militia in the room of James MINER who has Resigned, and Elias JOHNSON an Ensign, -Francis VAUGHAN a Captain in the room of Elisha [page break] [p] 49 Laurence BALLARD who has resigned, Richard DAUGHTERY a Lieutenant, and Solomon BUTLER an Ensign, -John BARBER a Lieutenant in the room of John WOODWARD who has resigned, and Humphrey REVELL an Ensign in the room of Jesse TURNER who has resigned- (in the first Batalion) James JOHNSTON a Captain in the room of Edmund GODWIN who has resigned,- Andrew WOODLEY a Lieutenant and Josiah GRAY an Ensign, (in the second Batalion) and that they severally and respectively be recommended to his Excellency the Governor as Capable persons to execute the Offices to which they are appointed- The Petition and Summon of Thomas KING Administrator of Jacob DICKINSON decd: against Joseph BENSON is Dismissed- The Petition and Summon of William JORDAN Administrator of Sarah CROCKER decd: against William BLUNT is Dismissed- On the motion of Josiah GODWIN for the Guardianship of Eliza GODWIN, and Susannah Jennett McCray Jack GODWIN Orphans of Thomas GODWIN decd: then als appearing Joseph GODWIN and moving for the same--- and thereupon the parties being heard and the Arguments of Councill on both sides, It is the opinion of the Court that the -- Guardian ship of the said Orphans should be granted the said Josiah GODWIN, (who together with Brewer GODWIN his Security entered into and acknowledged their bond in the penalty of two thousand pounds with condition as the law directs, for securing the said Orphans estate and indemnifying the Court). From which Opinion the said Joseph GODWIN prayed an Appeal to the next District Court to be holden in Suffolk, which is granted him, whereupon the said Joseph GODWIN: together with Jerimiah GODWIN his Security entered into & acknowledged their bond in the penalty one hundred pounds for prosecuting the said Appeal.- Ordered that the Court be adjourned till Tomorrow Morning 10 o'Clock The Minutes of these proceedings were signed:- Tho: SMITH At a Court Continued and held for Isle of Wight County the: the 8th: day of April in the year of our Lord One thousand seven hundred and ninety five- -Present- George PURDIE John GOODRICH &} Thomas SMITH George BENN } Gentlemen Justices On the Petition of Elizabeth CAMPBELL against Henry BRADLEY for three pounds four shillings (due by Account) This day came the plaintiffs by his Attorney as the Defendant in his own proper person and the parties being fully heard, It is the opinion of the Court, that the plaintiff recover against the Defendant the said sum of three pounds four shillings and her Costs by her about her Costs in this behalf expended- [margin note- "5-80- & 1-25."] On the motion of Joseph GODWIN a Witness for Henry BRADLEY at the suit of Elizabeth CAMPBELL: It is Ordered that the said BRADLEY pay him one Dollar and seventy Cents for two days Attendance at this Court and travelling eight Miles twice according to law- [page break]
