ISLE OF WIGHT COUNTY, VA - COURT - James B. NORFLEET et al. & Michael FOLK vs. Alexander H. ASHBURN, administrator of Mallory VAUGHAN Sr. et al. Sep 1866 - 1872 Chancery Suit [partial] ----¤¤¤---- [Document #1 - Bill of Complaint; 2 full sheets of paper, folded twice down its their length, creating four panels] [p. 1, obverse] To the Hon: Richard H. BAKER, Judge of the Circuit Court of Isle of Wight County, in Chancery sitting - Complaining shew unto the Court, Your Complainants, James B. NORFLEET, who sues for himself and all other creditors of Mallory VAUGHAN dec.d and Michael FOLK. Your Complainants respectfully represent to the Court and say, That the said Mallory VAUGHAN died on the [blank] day of [blank] in the year [blank], in the County of Isle of Wight, Intestate, and that Alexander H. ASHBURN duly qualified as his administrator in the County Court of Isle of Wight County, on the 7.th day of Octo. 1861 and took charge of his personal & Chattel estate, and has ["had" inserted] made out by a Commissioner of said Court, an account of his Transactions as such, which your complainants are willing to accept, so far as they are concerned, as prima facie correct - A Copy of which account is filed herewith as also a copy of the order of Court granting such administration and are marked A. & B. That the said Mallory VAUGHAN, died possessed of the following real estate to wit: (1.st) A Tract of four hundred acres, adjoining the lands of Anthony PERSONS, Joseph JOHNSON, Mills CRUMPLER & others; (2.d) A tract of one hundred and sixty acres, more or less, adjoining the Lands of [page break] [p. 1, reverse] Augustus OUTLAND, Meredith BUTLER & others - That the said Mallory VAUGHAN left as his heirs and distributees, his widow named Elizabeth, and Eight children, to wit: Zephariah; Joseph; Francis; William; Thomas; Sarah Ann; Texanna, & Mallory - That the said Zephariah died after his father and over twenty one years of age; that Joseph died next, over twenty one years of age, & whilst in North Carolina, & as your Complainant learns made a will which was recorded in some Court in North Carolina & giving his estate to some person or persons unknown to your Complainant; That Francis has also died, under twenty one years of age; That Mallory has also died, under twenty one years of age - That Texanna is now the wife of W.m UZZLE [UZZELL] - That ["Sarah" struck through] William & Thomas are alive & under under twenty one years of age - That Sarah Ann, being indebted to your Complainant Michael FOLK has given him an order for $176, which she designed should be paid out of her part of said estate & which your Complainant (Michael FOLK) prays may be done). see order filed herewith marked (C), Your Complainant prays that the accounts of Alexander H. ASHBURN as adm.r aforesaid may be duly settled, and that any balance he may may have in his hands may [page break] [p. 2, obverse] be applied to your Complainants demands - That the said Mallory VAUGHAN is justly indebted to your Complainant, James B. NORFLEET the sum of $145.97, with Interest from the 18.th day of May 1861. , as will appear by an account filed herewith marked (D) Your Complainants pray that the Dower in the said Lands may be assigned to Mrs: Elizabeth VAUGHAN, widow of said Mallory VAUGHAN dec.d or that she may be paid in fee simple a sum equal to the value of her Dower therein, if she shall prefer to accept the same, and that if required to pay your Complainants demand, that the Lands aforesaid may be Sold for that purpose - In consideration whereof, and as this Court has jurisdiction to grant proper relief.. To the End Your Complainants pray, That Alexander H. ASHBURN administrator of Mallory VAUGHAN dec.d, Elizabeth VAUGHAN (widow), William UZZLE and Texanna his wife, Sarah Ann VAUGHAN, William VAUGHAN & Thomas VAUGHAN, the last two Infants, & the unknown Legatee of Joseph VAUGHAN dec.d may be made Defendant's hereto, and be required to answer the allegations herein - and that the several prays of your Complainants may be granted, and that all further relief may be granted consistent with Equity &c John R.
