All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/va/vafiles.htm ************************************************ Isle of Wight County Virginia USGenWeb Archives Land Records Joseph BRITT & wife Elizabeth of Southampton Co. to Samuel MOODY of Surry Co., deed of bargain & sale, 400 acres, Isle of Wight Co., dated 14 Dec 1796, acknowledged 2 Jan 1797 [Isle of Wight Co., Deed Book 18] [p.] 97 [...] [margin notes] Britt & Ux.or} } to } Moody } This Indenture made this fourteenth day of December in the Year of our Lord Christ, One thousand Seven Hundred and Ninety Six Between Joseph Britt & Elizabeth his wife of Southampton County of the One Part and Samuel Moody of Surry County of the other Part Witnesseth that they the said Joseph Britt & his wife for and in Consideration of the sum of One Hundred and fifty Pounds current Money of Virginia to them in hand paid by the said Samuel Moody the receipt Whereof we do hereby _ Acknowledged have granted Bargained sold Aleined & Confirmed and by these presents do grant Bargain Sell Alien and Confirm unto the said Samuel Moody his Heirs and Assigns forever One Certain tract or Parcel of Land lying and being in the County of Isle of Wight being part of Land which the said Joseph Britt took up by Warrant and Pattent for the same in the Year of our Lord Christ One thousand Seven Hundred and Ninety Seven [sic*] recourse thereunto being had and Bounded as followeth (towit) Begining at an Oak on William Segars line thence North 45 D: E. 380 Poles to a white Oak thence due East 282 Poles to a red Oak stump a corner Jessee Thomas' field thence S: 9°: W: 214 Pole to Broad Water road to a red Oak a corner thence up Said Road to the first Station containing four Hundred Acres be the same more or less together with all woods, ways, waters, Profits, Commodities, Advantages, Hereditaments and Appurtenances whatsoever to the said Land and Premises in any wise Appurtaining the reversion and Reversions remainder and remainders rents and Profits of the same and every Part thereof and all the Estate right title Interest Property Claim and demand whatsoever of them the said Joseph Britt and Elizabeth his wife or their Heirs &c: of in and to their same and every part and Parcel thereof to have and to hold the said Land (appurtaining to the true intent of these Presents) unto the said Samuel Moody his Heirs and Assigns forever, and they the said Joseph Britt and Elizabeth his wife for themselves their Heirs Executors Administrators &c. do covenant Promis grant and agree to and with the said [page break] [p.] 98 Samuel Moody his Heirs and Assigns in manner and form following (to wit) that they the said Joseph Britt and Elizabeth Britt his wife their Heirs & all and every other Person or Persons claiming any estate or interest in the said Land and Premises or any part or Parcel thereof by from or under them or any of them shall & will from time to time and at all times forever hereafter make do and execute or cause to be made done and executed any further or other conveyances & Assurances in the Law for the Better and more Perfect conveying and Assuring the said Land and Premises unto the said Samuel Moody his Heirs and Assigns forever against the Lawfull Claim title and demand of all & every Person or Persons whatsoever shall & will warrant and forever defend by the Presents In Witness whereof We the said Joseph Britt and Elizabeth his wife have hereunto set our hands and affixed our seals the Year and Day first above mentioned ___ Signed Sealed Delivered and } Joseph Britt ĪSealĪ } her Acknowledged in Presents of } Elizabeth X Britt ĪSealĪ mark [no witnesses given] At a Court held for Isle of Wight County the 2d. day of January 1797 This Indenture was Acknowledged by Joseph Britt and Elizabeth his wife Parties thereto she having been first Privily examined as the Law directs freely and Voluntarily relinquished he right of Dower in the said Land and Ordered to be Recorded ___ Teste James Young Cl ***************************************************************************** *Additional information: It is hard to account for the error in the reference to the date of the "Pattent," except that the clerk was recording the deed in 1797. The deed may have been part of the first or third of the following grants (the only three found for Joseph in Isle of Wight Co.), although none of the distances correspond. Francis CLEMENTS was surety for Joseph BRITT on a bond for this conveyance.
