Isle of Wight County, VA - Deeds - Joseph & Polly HOLLADAY to William BATTIN August 7, 1809 *********** Isle of Wight County, VA Deed Book 21, Page 73 This indenture made this 7th day of August in the year of our Lord One Thousand, Eight Hundred and Nine, and in the 34th year of the Commonwealth of Virginia between Joseph Holladay and Polly his wife, of the County of Isle of Wight and State of Virginia of the one part, and William Battin of the County and State aforesaid of the other part. Witnesseth that the said Joseph Holladay and Polly his wife for and in consideration of the sum of five hundred dollars to them in hand paid by the said William Battin before the ensealing and delivery of these presents, the receipt whereof is hereby acknowledged, have bargained and sold unto the said William Battin his heirs and assigns, a certain tract or parcel of land containing by estimation two hundred and six acres to be the same more or less lying and being in the said County of Isle of Wight, adjoining Morrisons Spring, it being a part of the land formerly belonging to Thomas W. Gale, deceased, and Polly Holladay, the wife of the said Joseph Holladay and a daughter of the said Thomas W. Gale, became entitled thereto as her part by heirship, in a [devision] made; and bounded by the land of Jeremiah Westray, deceased, and the land of John Westray, deceased, now possessed by Benjamin Westray to Thomas's Swamp, thence running the said Swamp to the said land of Jeremiah Westray, deceased, aforesaid, together with all and singular the houses, orchards, tenements, hereditaments, and appurtenances whatsoever to the said land belonging or in any wise appurtaining and also the reversion or reversions, remainder and remainders, rents and services of the said premises or any part thereof, and all the estate, right, title, interest, claim and demand whatsoever of the said Joseph Holladay and Polly his wife of in or to the same or any part thereof and all deeds evidences and writings touching or in anywise concerning the premises to have and to hold the said plantation, tract or parcel of land and premises with the appurtenances to the said William Battin his heirs and assigns forever, and the said Joseph Holladay and Polly his wife, for themselves, their heirs, executors, administrators doth covenant, promise and grant to and with the said William Battin, his heirs and assigns forever by these presents, that they the said Joseph Holladay and Polly his wife, shall and will from time to time and all times forever hereafter make do and execute or cause and procure to be made done and executed all such further and other act or acts thing or things, devises, conveyances, and assurances in the law, for the further or better conveying and assuring the premises unto the said William Battin, his heirs, and assigns, as by the said William Battin, his heirs [and assigns] or his or their council [learnes] in the law shall be reasonably advised and required, and also that the said Joseph Holladay and Polly his wife, the said plantation, tract or parcel of land and premises will warrant and defend unto the said William Battin, his heirs and assigns, against them the said Joseph Holladay and Polly his wife, their heirs [and assigns ] and against all and every person or persons whatever claiming or to claim the same by from or under them the said Joseph Holladay and Polly his wife or any of them. In witness whereof we the said Joseph Holladay and Polly his wife hath hereunto set our hands and affixed our seals the year and date as first above written.
