H. Rawles, Trustee for J. N. Cutchin, to )Bargain and Sale, R. L. Holladay, This deed, made this 10th day of February 1908, between R. H. Rawles, trustee of Suffolk, VA of the first part, and R. L. Holladay of the County of Isle of Wight, Virginia of the second part. WHEREAS J. N. Cutchin and C. B. Cutchin his wife by deed bearing date of 3rd day of December, 1903, and recorded in the Clerk's Office of Isle of Wight County of Virginia in D.B. 68, Page 623, did convey to the said R. H. Rawles, Trustee in Trust, to secure to M. I. Arthur, the payment of a certain sum of money therein specified, the following real estate to-wit: All that certain tract or parcel of land, situated in Rascoe Neck, in Isle of Wight County, in the State of Virginia, and being a portion of the Nelson D. Hall farm, containing Thirty three (33) acres, more or less, and bounded as follows: Commencing at a point on Brewer's Creek, thence up a cove to a marked oak; thence in a straight line from oak to a gum tree on the public road; thence down a bottom to Brewer's Creek; thence up said creek to the beginning, and adjoining the R. L. Holladay land, the land formerly belonging to John Shepherd and Brewer's Creek, and the county road; and being the same land conveyed to the said J. N. Cutchin by R. H. Matthews, by deed dated January 13, 1903, and recorded in D. B. No. 68, Page 40, in the Clerk's Office of Isle of Wight County; and also including and conveying hereby about four (4) acres of oyster flats or grounds. By which Deed of Trust the said Trustee was empowered on the failure to the said J. M. Cutchin to pay the sum of money therein mentioned, or any part thereof, when the same should become due and payable, to sell the above described property for the purposes of the said trust. And whereas default having been made in the payment of the whole of the said sum of money, the said Trustee, in execution of the Trust aforesaid, being thereto required by the beneficiary, did on the 5th day of February 1908, after giving fifteen days notice of the time, place and terms of sale by advertisments in the Norfolk Landmark, Virginian-Pilot and Suffolk Herald and by hand bills duly posted in a number of public places expose to sale by public auction, to the highest bidder, the above described real estate. At which sale the said R. L. Holladay having made the highest bid therefor, became the purchaser fo the said property at the price of THIRTEEN HUNDRED ($1,300.00) DOLLARS, and having complied with the terms of sale, has requested that the same be now conveyed to him, the said R. L. Holladay. THIS DEED, THEREFORE WITNESSETH, That the said R. H. Rawles, Trustee in the performance of his duties as Trustee, and in consideration of the sum of THIRTEEN HUNDRED ($1,300.00) DOLLARS, paid and secured to be paid doth grant with SPECIAL WARRANTY, unto the said R. L. Holladay the said property hereinbefore referred to and described. Witness the following signature and seal: R. H. Rawles, Trustee (Seal) State of Virginia County of Nansemond, to-wit: I, L. D. Jacobs, a notary public, for the County aforesaid, in the State of Virginia, do certify that R. H. Rawles, Trustee, whose name is signed to the foregoing writing, bearing date the 10th day of February, 1908, has acknowledged the same before me in my County aforesaid.
