PINHORNE is indebted to the said Arch:d ATKINSON in the sim of $164.25 due the first day of August next after this date as gd:n of M.F. PINHORNE have granted, bargained and sold, and by these presents do grant, bargain, sell and convey, to the said Rob: H WHITFIELD his heirs and assigns, executors and administrators forever the following estate that is to say, one certain tract of land in the county of Isle of Wight conveyed to him by deed of the first day of May 1845, made by Elisha UZZELL and his wife Ann UZZELL and contains by estimation one hundred and eighty five acres be the same more or less (see said deed), To have and to hold the said tract of land and the appurtenances free from the Claims of the said Thomas U PINHORNE his heirs executors, admors: & assigns forever- upon trust nevertheless, that if the said PINHORNE shall well and truly pay to the said Arch:d ATKINSON his heirs exors:, adms, & assigns the said sum of $164.25 with all interest which may thereon have accrued, on the 1:st day of August next, and shall will truly pay all the expenses attending the execution of their deed, then this obligation to be void, But if the said Thomas U PINHORNE, his heirs, executors, admrs:, or assigns the said money and all interest then due on the said first day of August next, then the said WHITFIELD or his exors:, admrs:, his heirs or assigns or any lawfully constituted agents of the said ATKINSON or his assigns, after giving notice of the time and place of sale for at least ten day, in the town of Smithfield and county of Isle of Wight and also at the door of the court house [page break] of said county, Shall Sell to the highest bidder for cash the lands and other estate herein before described & mentioned & make a deed to the purchase- out of the amount of the purchase money he shall first pay the expenses of the sale and then pay to the said Arch:d ATKINSON his exors:, admrs:, or assigns, whatsoever sum of money shall be due at the time of the sale by virtue of the debt herein intended to be secured, and after discharging and the objects of this deed, then pay the balance if any to the said Thomas U PINHORNE his executors or administrators or his assigns. But the said Thomas U PINHORNE and his heirs & assigns are to have the use and contraul of the said hereby conveyed property till the same Shall be advertised for sale he paying the taxes and dues thereon and Surrendering it at the pleasure of the said trustee- And the Said Thomas U PINHORNE for himself and heirs warrants the title to the said land to the said WHITFIELD his heirs and assigns free fromm all persons- And the said LIGHTFOOT ["Lightfoot" underlined] trustee as aforesaid does covenant to perform the trust hereby reposed in him, faithfully and truly.
