VA Isle of Wight Co., VA, Deed Book 5, pp. 353-54 29 Dec 1744 Anthony FULGHAM to Benjamin TOMLIN Deed of Bargain & Sale This Indenture made the 26:th Day of August in the year of our Lord One Thousand Seven Hundred Thirty & Nine Between Anthony FULGHAM of the Isle of Wight County of the one part & Benjamin TOMLIN of the afores.d County of the other part Witnesseth that the said Anthony FULGHAM for and in Consideration of the sum of Nine pounds Current money of Virginia to him in hand paid at or before the Sealing & Delivery of these presents by him the said Benjamin TOMLIN the Receipt whereof he the said Anthony FULGHAM doth hereby Acknowledge and thereof doth hereby Acquit and Discharge the said Benjamin TOMLIN his Heirs and Assigns for Ever hath Given Granted Bargained Sold Aliened Released Enfeoffed and Confirmed and by these presents doth give Grant Bargaine Sell Alien Release and Confirm unto the said: Benjamin TOMLIN his heirs and Assigns a Certain Tract or parcel of Land Situate lying and being in Newport parish in the Isle of Wight County which is part of Seven Hundred & Eighty Acres Granted unto Anthony FULGHAM Dece'd Bearing Date the Sixth day of June In the year One Thousand Six Hundred & Seventy Six, Begining at the fork of the branch which Divides the Land and Anthony FULGHAM's and so up the branch to WILLIAMSONs Corner tree and so along FULGHAMs line to TOMLINs Corner tree & runing along Black water path to the head of a Small branch & so down the branch to the Begining Including so much as will make Seventy five Acres Together with all the Rights Members Appurtenances the said Tract or parcel of Land belonging and all Houses buildings Mines Mineralls Profits Commodities Emmoluments Libertys and privileges therein & thereon Contained or thereunto belonging or Appurtaining and the Revertion & Revertions Remainder & Remainders of all and Singular the said Premises To have and to hold the said Tract piece or parcel of Land & all other the premises herein or hereby Granted Bargained and Sold and Every part and percel thereof with their and Every of their Appurtenances unto the said Benjamin TOMLIN his heirs and Assigns to the only proper Use and behoof of him the said Anthony FULGHAM for himself his heirs Ex'tors and Adm:rs and Every of them doth Covenant and promise Grant and agree to and with the said Benjamin TOMLIN his heirs & Assigns in manner & form following (that is to say) That he the said Anthony FULGHAM hath in himself a Good Right and Absolute power & Authority to Grant Bargain and Sell the said hereby Granted premises with the Appurtenances unto the said Benjamin TOMLIN his heirs & Assigns as herein or hereby before is Mentioned or Intended And also that the said Benjamin TOMLIN [page break] his heirs and Assigns and Every of them for Ever peaceably & quickly shall and will Enjoy and possess the said premises and Every part and percel thereof without the Lawfull LawSuit Trouble denyal Eviction Interruption or Other Disturbances whatsoever of him the s.d Anthony FULGHAM his heirs or Assigns or any other person or persons Claiming by from or under him the said Anthony FULGHAM his heirs or Assigns or any other person or persons whatsoever laying Lawfull Claim thereunto or any part or percel thereof And also that the said premises hereby Given Granted Bargained & Sold with the Appurtenances now are and so for Ever hereafter shall remain Continue and be unto the said Benjamin TOMLIN his heirs & Assigns free & Clear & freely & Clearly Acquited Exonerated and discharged of and from all manner of former & other Gifts Grants Bargains Sale Leases Uses Wills Intails Annuitys Rents Arrears of Rents Judgements, bonds, Bills, Mortgages, forfetures and all Other Incumberances whatsoever And Lastly that he the said Anthony FULGHAM and his heirs shall and will from time to time & at all times hereafter make Execute Acknowledge or Suffer any further or other reasonable Act or Acts, Deed or Deeds Thing or Things Assurances or Devices whatsoever in the Law which he the said Benjamin TOMLIN his heirs or Assigns or his or their Council Learned in the Law shall be reasonable devised advised or required for the further Better and more perfect Assureing Conveying and Establishing of the hereby Granted & Barg'ined premises with their and Every of their Appurtenances unto the said Benjamin TOMLIN his heirs and Assigns ~~~~ to the Only proper use and behoof of him the s.d Benjamin TOMLIN his heirs and Assigns for Ever In Witness whereof the parties to these presents have Interchangeably sett their hands and Seals the Day and year first above Written.
