ISLE OF WIGHT COUNTY, VA - DEEDS - John Smelly To William Hatchell, 3 Jan 1753 ----¤¤¤---- (Isle of Wight County Deed Book 9, p. 53) This indenture the third day of january in this year of our Lord One Thousand Seven Hundred and Fifty-three between John Smelly of the County of Isle of Wight of the one part and William Hatchell of the said County part witnesseth that the said John Smelly for and in consideration of the sum of six pound nine shillings current money in Virginia hath bargained and sold, and by these presents, doth grant bargain sell and confirm unto the aforesaid William Hatchell one hundred acres of land more or less lying and being in the county aforesaid. Beginning at a corner pine of William Birch's land along a line of marked trees between Birch and the said land, to a corner white oak of Holleday's on a line of mark'd trees, between Holleday's and the said land to a corner white oak of the said Hatchell on a line of marked trees of the said Hatchell's and the said land to a corner pine of the said Hatchell's on a line of marked trees of the said Hatchell and the said land to a corner gum of the said Hatchell's and John Morris's and the said land to a corner pine sump of Morris's and the said land on between Morris's and this land to Birch's corner pine, the first station. To have and to hold the said tract or dividend of land above mentioned with all and singular the appurtenances thereunto belonging or anywise appertaining unto the said William Hatchell his heirs and assigns forever. Without the Lett Trouble Hindrance of him the said John Smelly his heirs or assigns and of all and every other person & Persons whatsoever, in witness whereof I the said John Smelly hath unto putt his hand & affix his Seal the Day & Year above written. Batten Know all men by these presents that I john Smelly of Isle of Wight County am held & firmly bound unto William Hatchell of the said County in the full and just sum of one hundred pounds sterling money to be paid to the said William Hatchell his certain Attorney Executors Adminrs or Assigns to which Payment well and truly to be made I bind myself my Heirs Executors adminrs firmly by these Presents sealed with my seal and dated this third Day of january in the Year of our Lord 1753. John Smelly (signed) her Sarah X Smelly mark The condition of the above obligation is such that if the above bound John Smelly, and his Heirs Executors Admins do & shall from Time to Time & at all Time's hereafter well and truly observe fulfill and Perform and keep all and every the Covenants Grants Articles & agreements which on their part are & ought to be observed performed & fulfill and kept particularly mentioned and expressed in one Indenture of Testament bearing Date even with these Presents & made or mentioned to be made between the above bound John Smelly of the one part & the above named William Hatchell of the other part in all things according to the true intent & meaning of the said Indenture the above obligation to be void otherwise to remain in full force & virtue. John Smelly came into Court & acknowledged his indenture of Bargain & Sale, with Bond to perform Covenants to William Hatchell and Sarah Smelly wife of the said John, having been privately examined relinquished her right o Dower to the Land mentioned in this Deed, which is ordered to be recorded.
