ISLE OF WIGHT COUNTY, VA - DEEDS - Anthony SPILTIMBER to John JENINGS [JENNINGS] 9 Apr 1668 Quit Claim and Deed of Bargain & Sale ----¤¤¤---- [p.] 128 Whereas Anthony SPILTIMBER of the County of Surrey Planter formerly Comenced suit of Law against John JENINGS before the Hono.ble Govern.r & Councill of State att a Generall Court held att James Citty in Sept.r 1665 in right of Mary his Wife Daughter of M.r Robert HARRIS lately of the County of Isle of Wight deceased and Sister unto Martha daughter of the said Robert HARRIS and late Wife to John JENINGS Concerning an Interest of Land which I supposed fell to me by right w.th marrieing the said Mary Youngest Sister to the said Martha, Which the said JENINGS in his right to his part of the said Land being Two hundred & fifty acres as marrying w.th the said Martha Altogeather defended Which suit soe by me Comenced against the said JENINGS received determination the Twenty seaventh day of March 1666 before the Govern.r & Councill And then there Ordered that the said JENINGS should should [sic] hould and Enjoy the said Land soe Claymed by me the said SPILTIMBER, which said Land soe sued for was made over to the said JENINGS and his Heires for ever by Martha his Wife and Acknowledged in the County Court for Isle of Wight by her the tenth day of October 1659 as by the said Conveyance in the Records more att large appeareth Now know ["ye" inserted] that I y.e said Anthony SPILTIMBER doe for me my Heires Executo.rs Administrato.rs and Assignes for ever quitt all claymes, rights Tytles, and Interests, unto the said Land or ant part or parcell thereof soe Conveyed to him the said JENINGS by Martha his Wife, And before her death And Mary my Wife the said Land due to us by marriage with them was equally devided and afterwards sould my right to John CLAY Senior which he now liveth upon, And the other division fell to the said JENNINGS And now possessed by him Which Land soe Conveyed I the said Anthony SPILTIMBER my heires Executo.rs Adm.rs and Assignes doe aprove allow and Acknowledge the said Conveyance to be good and from me to him and his Heires Executo.rs Administrato.rs and Assignes for ever ag.t [page break] [p.] 129 Against me the said Anthony my Heires Executors Administrato.rs & Assignes for ever more never to be questioned by us or any of us or any other Person by our procurement And further I the said Anthony SPILTIMBER doe by tese p'sents alientate bargaine sell enfeoffe assignes & make over all my right Tytle and interest in One hundred Acres of Land lying and being att the head of Greys Creek in the County of Surrey formerly Pattented by my deceased Father John SPILTIMBER, and by him bequeathed to me by his last Will and Testam.t with all houses and Orchards thereon built & Planted as likewise One hundred & fifty Acres of Land lying att Blackwater in the County aforesaid being part of A greater quantitie taken up by me and Pattented in my owne name which said Land soe herein mençoned lying and being in The County of Surrey being Two hundred and fifty Acres of Land is to belong [small "×" above "g"] properly and of due right to the s'd John JENINGS his Heires Executo.rs mençoned soe alientated and sould by the s'd SPILTIMBER to the said John JENINGS and his Heires is to be surrendered forthwith into the said JENING's ["Jenings"] Possession, If ever I the ["sd" inserted] Anthony SPILTIMBER my heires Ex.rs Administratores or Assignes or any other Person or persons by our or any of Our procurem.ts or setting on, Ever hereafter disturbe molest sue or implead the said John JENINGS his heires Executo.rs Administrato.rs or Assignes for and Concerning the Land soe devided and due to him as by the Conveyance made to him by his WIfe Martha as aforesaid and
