Francis WYATT K.t Gov'n.r & Cap.t Gen'all of Virginia, send greeting in o.r Lord God Everlasting whereas by instrucçons from y.e Kings most Excellent ma.tie directed to me & the Councill of State his ma.tie was gratiously pleased to authorize me the s'd Gov'n.r and the Councill to grant pattents and to grant such proporçons of Lands to all adventurers of mony or transportaçon of People to this Collony accordeing to Orders of the late Companie and since allowed by his ma.tie And likewise that there be y.e same proporçon of fifty Acres of Land granted & assigned for every person that hath been transported to this Collony since Midsumer 1625 and that the same course be continued to all persons transported hither untill it shall be otherwise determined by his Ma.tie Now ['Know' omitted] scituate lyeing & being in the County of the Isle of Wight, and lying upon A Branch of Seawards Creek begining att A marked Oak standing in the s'd Branch or Swamp and runing North East One hundred Ninety four pole by & adjoyning on the Land of John SEWARD unto A marked Redd Oak and soe North North East One hundred thirty three Pole adjoyning on John SEWARD unto a marked Poplar and soe North East [PB1:751 gives "North west"] one hundred Ninty four Poles on the Miles end of the Land of Cap.t John UPTON from y.e main River unto a marked Poplar, And soe South South West one hundred Thirty three pole by A marked Ash standing in the s'd Branch or Swamp and soe downe by the East South East side of the said Branch unto another m'ked Ash standing in the s'd Branch being the first mençoned marked Tree including the said One hundred & fifty Acres of Land, w.ch said One hundred & fifty Acres of Land is to be augmented & doubled when he or his Assignes shall have sufficiently peopled and planted the same The said 150 Acres of Land being due unto him the s'd Thomas GREENWOOD for his owne P/sonall Adventure and y.e transportaçon att his owne proper Cost & charges twoe persons into the Collony all whose names are in the Records mentioned under this Pattent [page break] [p.] 240 To have & to hould the said 150 Acres of Land w.th his due share of all Mines & Mineralls therein conteined and w.th all rights & priveledges of hunting hawking fishing & fowling alsoe all woods Waters & Rivers & all proffitts Comodities & hereditam.ts w.t soever within the p'cinct of the said hundred & fiftie Acres of Land or to the said Land or any of them in any case belonging unto the said Thomas GREENWOOD his heires & Assignes for ever, in as large & ample manner to all intents & purposes, as is expressed in A Charter of Orders from the late Treasurer & Company bearing date y.e 10.th of November 1618 as by consequence may be Justly collected out of the same or out of the Letters Pattents whereon they are grounded To be held of o.r Sovereigne Lord the King his heires & Successors as of his Mann.r of East Greenwitch in free & Comon Soccage & not in Capite or by Knights service Yeilding & payeing unto o.r Sov'eigne Lord the King his heires & Successors for ever, or to his or their Treasurer for every fifty Acres of Land herein ["granted" struck through] by these p'sents given and granted yearly att the feast of S.t Michaell the Archangell the fee rent of one shilling to his ma.ties use w.ch paym.t is to be made Seaven yeares after the date of this Pattent & not before According to the Charter of Orders from the Treasurer & Company & confirmed by his Ma.ties instrucçons as alsoe by Act of Assembly beareing date the Sixth of Jan.ry 1639 [1639/40] Provided alwaies y.t if the said Thomas GREENWOOD his heires or Assignes shall not plant or seat or cause to be planted on the said 150 Acres of Land w.th in the tyme or terme of three yeares, now next ensueing the date hereof That then it shall and may be lawfull for any adventurer or Planter to make Choice & seat upon the same Given att James Citty under my hand & seal of the Collony this 28.th dec'ed to whome the land here in this Pattent mençoned being 150 Acres did properly belong Now know that I the s'd Thomas EDWARDS & Elizabeth my Wife, doe for our selves o.r heires Executors & Adm.rs & for each & either of us, our & either of o.r Ex.rs & Administ.rs Alienate Assigne & sett over all the right Tytle interest & clayme w.ch wee have to the Land in this Pattent mençoned unto John JENNINGS of the County afores'd and to his heires Executo.rs Adm.rs or Assignes for ever, haveing rec'ed from him before the signeing & sealing hereof A full & valluable ['consideration' omitted] from in his life tyme w.ch said One hundred Acres of Land soe sould by us the said Thomas & Elizabeth EDWARDS unto y.e s'd John JENINGS lyeth att y.e Miles end, of the Land included in the s'd Pattent of Three hundred Acres as afores'd and to take its begining from One hundred & fifty Acres of Land w.ch wee the s'd Thomas & Elizabeth have already sould unto the s'd John JENINGS being included in a Pattent & formerly taken up by & in the s'd Thomas GREENWOODs name and soe to runn towards the maine Road and for breadth of the said One hundred Acres of Land soe by us sould it is to begin att the Miles end and soe from the lyne of marked Trees between me the said EDWARDS & John WAKEFIELD to cross through y.e Woods and soe to runne A Thwart unto the Line of John JENINGS his marked Trees belonging to the fifty Acres w.ch the s'd JENINGS formerly bought of Vallentine CHITTY [page break] [p.] 244 And given the s'd CHITTY by the s'd Thomas GREENWOOD in his Will as by the same may more att large appear In w.ch said One hundred Acres are by us the said thomas & Elizabeth sould unto the s'd John JENINGS his heires Executors Adm.rs & Assignes, the plantaçon where John GRAVE now liveth is included & belongeth to the s'd One hundred Acres soe Alienated as afores'd To have & to hould the said One hundred Acres of Land herein mençoned w.th all Royalties, priveldges Edifices fences houses & Orchards thereon w.th warrantie of the Same to him the s'd John JENINGS his heires Executo.rs Adm.rs & Assignes for ever haveing rec'ed of the s'd JENINGS before the signeing and Sealing of
