JORDAN Dec.d [>] formerly lived ["near" struck out] Near Marshalls Mill with the appurtenances, now in the tenure of, &c. There is to be none of the above named land cultivated in oats, wry, or wheet [sic], and none of the said land to be cultivated in Corn oftener than once in two years, except, in cotton, pees [sic] or potatoes; To have and to hold the Said lands Unto the Said [>] Nathan MOUMFOURT his executors, administrators, and assigns, from the [>] 1.st day of January 1841 next ensuing the date hereof, for and during, and unto the full end and turm of three years, from thence next ensuing, and fully to be complete and ended: Yielding and paying thereof, yearly and every year, during the Said turm, unto the said Elmina JORDAN the yearly rent or sum of [>] Thirty dollars & [>] _____ Cents on the 1.st day of January in each year, by even and equal portions; the payments thereof to commence on January 1.2t 1842 next ensuing: Provided always and upon condition nevertheless, that if it shall happen that the Said yearly rents hereby reserved, or either of them, or any part of them, shall be, behind and unpaid by the space of [>] 30 [altered from "20"] days next over or after either of the days of payment, whereon the same ought to be paid as aforesaid, being lawfully demanded; or if no sufficient distress can be found on the premises hereby demissed, whereof to make the said rent, at the time when the same shall be payable; or if the said [>] Nathan MOUMFOURT his executors, or administrators, or any of them shall assign over, or otherwise part with this indenture, or the premises hereby leased, or any part thereof without the consent of the Said Elmina JORDAN her heirs or assigns first had and obtained inwriting under her or their hands and seals for that purposes, then and in either of the said cases, it shall and may be lawful to and for the said Elmina JORDAN her heirs or assigns, into the premises herein leased, or any part thereof, in the name of the whole, to reenter and the same to have again, repossess, as in her and their first and former estate, any thing herein to the contrary contained notwithstanding; And the said [>] Nathan MOUMFOURT doth for himself his heirs, executors &c. covenant and agree to and with the said Elmina JORDAN her heirs and assigns, that he the said [>] Nathan MOUMFOURT his heirs executors &c. Shall and will well and truly pay, or cause to be paid unto the said Elmina JORDAN her heirs or assigns, the said yearly rent of [>] Thirty dollars & [>] _____ Cents at the days times and place, and in such manner as are herein before appointed for payment thereof, according to the respective reservations thereof aforementioned, and the true intent and meaning of these presents, And that the Said [>] Nathan MOUMFOURT his heirs executors, administrators & assigns [page break] [Image 0194- 2nd & 3rd pages of 4, 3rd page blank] Shall and will at their own proper costs and charges, well and sufficiently repair, amend, preserve and keep in repair the said tenements (except Natural decays), with all houses, fences &c. thereto belonging during this present lease (accidents by fire or the act of God excepted) And also that it shall be lawful for the said Elmina JORDAN (or her next frient [sic]) her heirs and assigns with workmen and others, in his company, or without, at any time in the day time to enter peaceably on the demised premises, during the said turm, to view the state of the reperations thereof; and of all such decays, and want of reparations then and there found, to give notice to the Said [>] Nathan MOUMFOURT in writing, or to have the same on the dimised [sic] premises, at the most conspicuous place thereon, to repair the same within the space of six months next ensuing; within which time the said [>] Nathan MOUMFOURT for himself, his executors, administrators and assigns, doth covenant and agree to repair and amend the same accordingly, and that he the Said [>] Nathan MOUMFOURT shall preserve fruittrees, the litter ["& manure" struck out] made upon the land shall be fed upon it, roted and carried out and plowed in said land; and that the out fences and cross fences to be kept up and run in the direction they now run; And lastly that his heirs Executors, administrators, and assigns paying the rents herein before mentioned or contained, and which on his and their parts and behalfs are or ought to be paid, done, and performed peaceably and quietly to have hold, occupy, possess and enjoy, the said premises hereby leased, with the appurtenances during the said turm of three years hereby granted without any molestation, or interruption whatsoever, of or by her the said Elmmina JORDAN her heirs or assigns, or of or by any person or persons, lawfully or equitably claiming or to claim, from by or under her them or any of them.
