GAY Jany 19:th 1847 This Indenture Made and entered into this 16th day of Feby one thousand eight hundred and forty four between Tho.s MOUNTFORD and Mary his wife of the first part, Josiah P. GAY of the second part and Elisha GAY of the third part and all of the County of Isle of Wight and State of Virginia, Whereas, the said Thomas MOUNTFORD is justly indebted to the said Elisha GAY in the sum of one hundred and thirty four dollars and eighty seven cents, as by a bond bearing date the day and date above written, which debt with legal interest thereon the said Thomas MOUNTFORD and Mary his wife is willing and desirous to secure &c Now this Indenture Witnesseth that for and in consideration of the premises, and also for the further consideration of one dollar to the said Thomas MOUNTFORD and Mary his wife in hand paid by the said Josiah P GAY at and before the ensealing and delivery of these presents the receipt whereof is hereby acknowledged he the Said Thomas MOUNTFORD and Mary his wife hath given granted, bargained and sold, aliened, enfeoffed, released and confirmed, and by these presents doth give, grant bargain Sell alien enfeoff release and confirm to the said Josiah P GAY his heirs and assigns forever all our right title and demand in the tract of land whereon we now reside Containing by estimation one hundred acres more or less and bounded by Willis ELEY William T. BEATON, Elisha GAY's land and others, also the following personal property (to wit) fourteen head of hogs, twenty barrels of corn, three thousand pounds blade fodder, one cart and wheels, all my ploughs, all the balance of my farming utensels, two featherbeds & furnature, and all the balance of my household and kitchen furnature & our Gun, Also all the right both at Law and in equity in my mother Lucy LOWE's estate, (And all the right which we_ or may have in the dower of negroes which were set apart out of the negroes of Jacob BEAL decd: to Louiza BEATON (who is now the wife of William T. BEATON), To have and to hod the said tract or parcel of land together with the personal property and the increase thereof, and all our right named above in Lucy LOWE's estate, And the dower right in negroes and the increase thereof unto the said Josiah P. GAY his heirs and assigns forever, upon trust nevertheless [page break] that the said Josiah P GAY Shall as soon as he can conveniently after the first day of October next ensuing and having advertised the time and place of Sale of said tract or parcel of land and the other personal property &c by these advertisements to be posted at seven public places, near the premises ten days previous to the day of Sale there proceed to sell the same to the highest bidder for ready money, and out of the money arising from such sale first pay off all necessary expenses attending the Sale and then pay to the said Elisha GAY the debt aforesaid with legal interest thereon and the balance if any pay to the said Thomas MOUNTFORD and Mary his wife their heirs or assigns on deliverance.
