day of June AC One thousand Eight hundred and eleven between William MOUNTFORT and Dorey his Wife of the County of Isle of Wight & State of Virginia of the One part and John WHITFIELD of the County & State aforesaid of the other part: Whereas the said William MOUNTFORT was lately seised in his demesne of fee & right of and in the tract of land herein after mentioned and being desirous to secure to a certain John ELY now decd: lately of the aforesaid County the payment of the sum of Fifty seven pounds 1st due and owing to the said Jn.o ELEY [page break] he the said William MOUNTFORT executed to the said John ELEY an absolute cnveyance for the said tract of land & took obligation of the said John ELEY conditioned to reconvey the said land, or the payment of the said money at the period therein specified, which payments were accordingly made, but the said John ELEY failed to reconvey during his lifetime, and whereas a suit in Chancery has been instituted by the said William MOUNTFORT against the heirs of the said John ELEY to obtain a reconveyance of the said land: Now this Indenture Witnesseth that the said William MOUNTFORT and Dorey his Wife in consideration of the sum of seven hundred dollars to them in hand paid by the said John WHITFIELD at or before the ensealing and delivery of these presents the receipt whereof is hereby acknowledged & he the said John WHITFIELD his heirs executors and administrators thereby acquitted, released & discharged- Have and each of them hath bargained & sold & by these presents do and each of them doth bargain & sell, unto the said John WHITFIELD his heirs and assigns all that tract of land above mentioned & all their right title interests & claims thereto both at Law and in Equity- which said tract of land is situate lying & being in the County & State aforesaid containing by estimation one hundred & ten acres more or less and bounded as follows beginning at a Hickory tree a corner tree between the lands of Joseph JOHNSON Wade MOUNTFORT and said tract of land thence a straight line between the s.d Wade MOUNTFORT and the said land to the mouth of the deep branch that empties in the Goose-pond then to Black Water and then then down Black Water to the mouth of a Branch dividing the lands of Joseph DUCK & said land thence up s.d branch to a pine at the head of said Branch then along a line of marked trees to a red Oak a corner between said DUCK the and the said land & then a straight line to the first station, and all singular tenements appurtenances hereditaments & premises & the reversion and reversions remainder and remainders yearly and other rents issues profits thereof and of every part & parcel thereof To have and to hold the said tract or parcel of land together with all and singular the tenements, appurtenances hereditaments and premises the reversion & reversions remainder and remainders yearly & other rents issues & profits thereof & of every part and parcel thereof and all the interest right and title of them the said William MOUNTFORT and Dorey his Wife both at law and in equity to him the said John WHITFIELD his heirs and assigns forever and to and for the only proper use and behoof of him the said John WHITFIELD his heirs and assigns forever.- And the said William MOUNTFORT and Dorey his Wife for themselves their executors adm.rs & heirs do & each of them doth covenant promise and grant to and with the said Jn.o WHITFIELD [page break] his heirs and assigns in manner and form following to Wit- that by no act of them the said William MOUNTFORT & Dorey his Wife or any ancestor, by or through whom they or either of them claim or any other person or persons whatsoever hath the said land with the appurtenances & hereditaments and all and singular other the premises herein before mentioned, bein in any manner imcumbered except by the Conveyance above mentioned to the said John ELEY and that on the day the said conveyance was made he the said William MOUNTFORT was seised in his demesnes of a clear & indefeasible estate in fee simple in the aforesaid tract of land with the appurtenances & hereditaments &.c And the said William MOUNTFORT and Dorey his Wife for themselves their heirs executors & administrators do and each of them doth further covenant promise & undertake, that the said John WHITFIELD shall be made a party compl.t to the suit in Chancery against the heirs of the said John ELEY for a conveyance of the legal estate in the aforesaid tract of land appurtenances hereditaments & premises & that the said William MOUNTFORT & Dorey his Wife their & each of their heirs Executors & administrators shall and will by due course of law obtain a reconveyance of the legal estate of the said tract of land & premises & that they will procure the said conveyance to the said John WHITFIELD, his heirs or assigns.- And the said William MOUNTFORT and Dorey his Wife for themselves their heirs & assigns the said tract of land with all and singular the premises appurtenances & hereditaments thereto belonging unto the said John WHITFIELD his heirs and assigns against the claim of them the said William MOUNTFORT & Dorey his Wife their heirs and assigns & against the claim or claims of all and every person or persons whatsoever shall will & do covenant and forever defend by these presents- In Witness Whereof the parties hereto have set their hands and
