This Deed made this 9_th day of December, in the year One Thousand, Eight Hundred and Eighty-two, between William E. MUNFORD and Emily J. MUNFORD, the wife of the said William E. MUNFORD, of the one part and John H. BEATON, Trustee, of the other part, all of the County of Isle of Wight and State of Virginia, Witnesseth, that the said William E. MUNFORD and Emily J. his wife, in consideration of the indebtedness hereinafter mentioned, and of the sum of one dollar to them in hand paid by the said John H. BEATON, Trustee, the receipt whereof is hereby acknowledged, do hereby grant, bargain and sell, release and convey unto the said John H. BEATON, Trustee, the following real estate, to wit: A certain tract or parcel of land situated in the County of Isle of Wight and adjoining the lands of Odom BRADSHAW, Thomas M. SAUNDERS, H.T. MORRISS and others, and better known as the Lucy LOWE and Thomas MUNFORD land, it being the same purchased by the said William E. MUNFORD of Mills L. WATKINS and Louisiana his wife (as per deed dated on the twenty-sixth day of August, in the year one thousand eight hundred and seventy-four (1874) and duly recorded in the Isle of Wight Clerk's Office, and containing two hundred and fifty seven acres, more or less, In trust nevertheless for the following purposes- Whereas the said William E. MUNFORD is justly indebted to Charles CRUMPLER in the sum of one hundred and seventy-five dollars ($175.00) due by bond bearing even date with these presents and payable twelve months after date, with interest from date, now in case of default in the payment of said ['sum'] or any part thereof, or the interest accruing thereon, according to the tenor and effect thereof, the said Jno. H. BEATON (by Power being hereby given) or his legal representative, after having advertised such sale Twenty days, by posting up written or printed notices in three or more public places in said County (personal notices being hereby expressly waived) shall sell the said premises or land for cash, and shall apply the proceeds first to the payment of all advances made by the said party of the second part, for taxes, advertising, selling and conveying the said land, including a Commission of five per centum on the gross amt: of sale; second to the payment of the aforesaid bonds of the amount of one hundred and seventy five dollars ($175.00) and all accrued interest thereon; Third, to the payment of all the other creditors of the said William E. MUNFORD in an equal per centum of their several claims; Fourth, rendering the overplus if any there be to the said William E. MUNFORD or his legal representative. And the said William E. MUNFORD and Emily J. his wife, parties of the first part, hereby expressly waive, release and relinquish unto the said party of the second part, his heirs, executors, administrator and assigns, all right, title, claim, interest and benefit whatsoever, in and to the above described piece or parcel of land, containing two hundred and fifty-seven [page break] [p.] 703 acres, more or less, which is given by, or results from all laws of this State, pertaining to the exemption of homestead- Provided that the said William E. MUNFORD, his heirs and assigns may hold and enjoy said premises, and the rents, issues and profits thereof, until default shall be made as aforesaid- And the said parties of the first part covenant with the party of the second part that they have the right to sell and convey the aforesaid tract of land containing two hundred and fifty-seven acres more or less, that they have done no act to encumber the same and that all further assurances necessary and proper shall be executed- Witness the hands and seals of the said William E. MUNFORD, wife of the said W.m E. MUNFORD, whose names is also signed to the said writing, also personally appeared before me & after having said writing fully explained to her, & on being examined by me separately & apart from her said husband, she, the said Emily J.
