ISLE OF WIGHT COUNTY, VA - DEEDS - Thomas SMITH Jr. to Thomas UZZELL, 3 Jun 1747 Deed of Bargain & Sale ----¤¤¤---- [p.] 472 This Indenture made the Third day of June in the Year of our Lord One Thousand Seven Hundred Forty Seven Between Thomas SMITH Gent. of the County of Isle of Wight of the one Part and Thomas UZZELL of the aforesd. County of the other Part Witnesseth That the said Thomas SMITH for and in Consideration of the Sum of Thirty Pounds Current Money of Virginia to him in Hand Paid at and before the Enealing and Delivery of these Presents the Receipt whereof he doth hereby acknowledge and thereof and of every Part and Parcel thereof doth hereby acquit Exonerate and discharge the said Thomas UZZELL. And therewith fully Satisfied Contented and Paid Hath by these Presents Given, Granted, Bargained and Sold and by these Presents Doth hereby Give, Grant, Bargain and Sell unto the s.d Thomas UZZELL his Heirs and Assigns for ever All that Tract or Parcel of Land whereof James EWART late of this County died Possessed of Containing two Hundred twenty two Acres more or less Situate lying and being in the County of Isle of Wight. And by the s.d Thomas SMITH Escheated from the afores.d James EWART who died without Heirs and Bounded as by Patent Granted to the s.d Thomas SMITH remaining among the Records in the General Court of this Colony. To have and to hold the said Land Tenements and Premises and Hereditaments with their and every of their Rights, Members, Jurisdictions and Appurtenances, together with all Houses, Edifices, Buildings, Gardens, and all other Appurtenances whatsoever thereto belonging, to him the said Thomas UZZELL his Heirs and Assigns for ever. And the said Thomas SMITH doth hereby Covenant and Agree to and with the said Thomas UZZELL his Heirs and Assigns that the af.sd Thomas SMITH at the Time of the Sealing and Delivery of these Presents is and stands Lawfully Seised in the above Granted Premises with the Appurtenances and every Part and Parcel thereof in a good sure and Indefeasible Estate in fee Simple and that he hath good Right full Power and Lawfull Authority to sell and Convey the same and that he the said Thomas UZZELL his Heirs and Assigns may and shall from Time to Time and at all Times forever hereafter Peaceably have hold Occupy Possess and [page break] [p.] 473 Enjoy the above Granted Premises with the Appurtenances and have receive and take the Rents Issue and Profits hereof to him and their own Proper Use for ever without Lett, Suit, Trouble, Denial, Interruption or Disturbance of him the said Thomas SMITH his Heirs, Exec:rs Adm:rs or Assigns or of any other Person or Persons whatsoever having Claim or pretending any Right Title or Interest thereunto And he the s.d Thomas SMITH for himself his Heirs or Assigns doth further Covenant & Agree to and with the said Thomas UZZELL his Heirs, Executors Adm:rs or Assigns to Warrant and Defend the same from the Claim or Claims of any Person or Persons whatsoever. And further that he will make, do, and Perform and Acknowledge all and every such further and other Act and Acts thing and things Devises and Assurances in the Law whatsoever for the more sure Conveying and Confirming the Premises as shall be by the s.d Thomas UZZELL his Heirs and Assigns or his or their Counsel learned in the Law be reasonably Devised Advised or Required. To the true Payment whereof to be made to the s.d Thomas UZZELL his Heirs &c. I Bind my self my Heirs Exec:rs Adm:rs Jointly and severally firmly by these Presents.
