The gunman, hospitalized today in the intensive care unit of Maryview Hospital, was shot by Joseph D. Hurst, owner of Bennett's Creek Sunoco, located one mile west of Bennett's Creek Restaurant on Rt. 17. Hurst told Nansemond County Police the gunman, driven by a woman later identified as the man's 19-year-old wife, got out of the passenger side of a late model Oldsmobile brandishing a shotgun. He had a panty-hose stocking over his head. He ordered Hurst into the office of the service station, demanding money and guns. (Hurst is also a gun dealer, county police said.) The gunman told Hurst to put the money in his pocket. To facilitate Hurst's putting the money in the suspect's pocket, the gunman shifted his shotgun aside. At this point, Hurst drew a .38 caliber revolver from a holster at his side and began firing. The first shot struck the firing mechanism of the shotgun. In the opinion of the investigating officer, Det. G.A. Cipra, this prevented the suspect from returning fire and possibly saved Hurst's life. Hurst continued firing, striking the suspect three times, once in the arm and twice in the chest and ribs. The suspect backed or staggered into the bay area of the station where he dropped his weapon. He then fled in the car driven by his wife east-bound on Rt. 17. Hurst fled the scene and then called county police who put out an all points bulletin for the suspects. The first officers on the scene were S.E. Glover and T. Newsome. The suspects were apprehended at Maryview Hospital. Warrants are on file with Nansemond police charging the man with attempted armed robbery and the woman with being his accomplice. Investigating officers, using a search warrant, discovered a panty hose stocking and a .38 caliber revolver in the suspects' car, which was found at Maryview Hospital. The gun had blood stains on it, police said. ****************************************************************************** RYLAND W. (BILL) ASHBY JR.
