ISLE OF WIGHT COUNTY, VA - WILLS - Francis AYRES 13 Jan 1676 ----¤¤¤---- [p.] 139 In the Name of God Amen; the 13:th of January 1675: I Francis AYRES of the Isle of wight County, beinge Sicke & Weake of Body; but of p/fectt Mind & Memorie, thankes be to God, therefore; doe make & ordaine, this my last Will & testam.t First & principally I Give my Soule, into the hands, that gave it mee, And for my Body I com'end Unto the Earth, to be buried, in Christian & decent Manner, not dowbtinge att the Gennerall Resurrection, to receave the Same, by the Mightie power of God, And for my Worldly Estate, I bequeath as followeth / Imp'mis, I Give & bequeath; the one halfe of my p/sonall Estate, Unto my Welbeloved Wife Jane AYRES, And the other halfe of my p/sonall Estate, Unto Humphra CLARKE, the Sonne of John CLARKE, & for all my lands Tenem.ts heritatm.ts Whatsoever, that I have now in my possession, or have right Unto, I doe give and bequeath, Unto the aforesaid, Humphra CLARKE, & to his heires, lawfully begotten for ever, And if it shall soe happen; that the Said Humphra CLARKE, die, before he Attaines; to the Age of twentie one yeares then my Will is that my land & p/sonall Estate; shall decend & Come, to Robert CLARKE, Brother to the Said Humphra CLARKE; And to his heires for ever, And my Will is, that Jane my beloved Wife, shall have the possession & Use of this plantation, dureinge the terme of her Naturall life, & my Will is, that the Said Humphra CLARKE live w.th his Grand Mother, my beloved Wife Jane, on the plantation before, Mentioned And to have his Maineteneance, & education in learninge, out of the labour of Servants & produce of the said plantation, And as for my two Negroes; I doe give one Negro, Named Francis, to the aforesaid Humphra CLARKE, and the other Negro, Called Toby, to my Welbeloved Wife, Jane, & the rest of my Servants, And if it shall soe fall out, that the aforesaid Negros doe refuse, & are not Willinge to live w.th my aforesaid Wife, Then my Will is, that my said Wife make Sale of the said Negros & W.th the produce purchase English Servants, for the Use, of my said Wife, & Humphra CLARKE as aforesaid; And my Will is that Jane AYRES, my Wife, be Whole & sole Executrix; of this my last Will & Testam.t And my Will is That my Welbeloved friends, m:r Robert FLAKE; & M.r John CLARKE, be my overseers, to see this my last Will & testam.t p/formed, Wittnes my hand & Seale, the day & yeare above Written; Francis AYRES / Sigill.
