Devised August 10, 1700, Proven January 9, 1700/01. In ye Name of God Amen, I James Day of ye Isle of Wight County in Virginia being very sick & weak in body but of sound perfect & disposing mind & memory, all Laud & praise be given to Almighty God therefore, and calling to remembrance ye frailty of human Nature, the Certainty of Death & uncertainty of ye tyme when, doe make Ordyn & declair, my last Will & Testamt in manner Following, That is to say, In ye First & principall place, & that wch is Farr more to be regarded, then all Outward goods or Injoymts, I Comend my soul to God ye ffather of Spirrits trusting & Firmely beleeving, thro ye merrits & bitter passion, of my alone Savior & Redeemr Jesus Christ to receive Full pardon & remission For all my Sins whenever this mortall life shall cease, and my body to be decently interred after ye manner of Xian buriall, att ye discretion of my Exrs hereafter named, And for what worldly Estate it hath pleased the Lord to possess me wth, after all my Just debts & Funerall charges is deFrayd, I give bequeath & dispose of as Followeth, I give & bequeath to my loveing & beloved Children, Elizabeth, James, Thomas and William Day, to each of them three hundred pounds sterling, to be pd to my said Daughter Elizabeth when shee comes to ye age of Eighteen yeares or is marryed Which shall first happen, & to my said Sonns when they sevrally come to ye age of Twenty one yeares and in Case any of my said Children should dye, before they attaine to ye Yeares above menconed, It is there my Will & desire, that his her or their part, soe dying shall remain & belong to ye Survyvor or Survyvrs of them. It[em] I give & bequeath to my aforesd Sonn James Day, and to ye Heires of his body lawfully begotten For ever, all my Lands Tenemts & Hereditamts, in ye Isle of Weight County in Virginia,Excepting onely ye plantacon wth ye appertences, whereon I now live, which said plantacon wth ye appertences, I give & bequeath to my dear and well beloved Wife Mary For & dureing her Naturall life, and att her decease, I give & bequeath my said plantacon, & ye appertences to my aforesaid sonne James, and to ye Heires of his body lawfully begotten For ever, and For want of such Heires I doe in like manner give & bequeath all my afforesaid Lands to my sonne Thomas Day, and to ye Heires of his body lawfully begotten Forever, And For want of such Heires of my said sonne Thomas I doe in like manner give & bequeath all my aforesd Lands, Tenemts & Hereditamts to my sonne William Day & to ye Heires of his body lawfully begotten For ever, And I doe alsoe further give to my Sonne James Day A Negro Boy called George and my Negro Girl called Sarah and my Scrittore & my Rapeor. Item It is my Will & desire and I hereby direct & appoint that For & toward ye raiseing of mony to answer ye sevrall Legacies to my Children above given, and For the better & more Orderly bringing up & educating of ym my said Children, that my two ffreehould Messuages or Tenemts wth their appertences, Now in ye sevrall occupacons of Jno Toft, & ye Widdow Mitchell, and scituate lying & being in Broad street wthin or near ye precinct, & Circuit of ye late disolved House priory or Monastry, comonly called ye Augustine ffryars in ye parish of St. Peter ye Poor in London, be imediatly putt to sale & disposed of to ye best advantage, and I doe hereby enable authorize & impower my good & worthy ffreinds, Mr Micajah Perry Mr Thomas Lane & Mr Richd Perry, all, any, or either of ym Jointly or sevrall to dispose & make good & authentick sale for ye we aforesd of all & singuler ye aforesd Messuages & Tenemts wth their apertences in ye parish of St. Peter ye Poor in London aforesd. I give & bequeath to my sonne James Day my watch my Silver headed Cane my seal & Coat of armes & my Rapier. I give & bequeath to my hond Aunt Mrs Silvestra Hill, to my Brother & Sister Chapman, to my Brother & Sister Swan, to Mrs Isabell Havelid Mr Jno Havelid, Major Henry Baker, Major Henry Tooker, Major Arthur Allen Twenty shillings apeice to buy each of them a Ring. I give & bequeath to my loveing Wife Mary Day after my debts & Legacies pd in Full of her Dower all ye rest & remaidner of my estate of what nature, kind, property or quallity soever it be either home in Virginia, In England or Elsewhere, makeing her my loveing Wife, & my Worldly ffreind Mr Luke Havelid Exrs of this my last Will & Testamt.
