Devised October 7, 1676. Registered June 9, 1677. In the Name of God Amen, I John Hardy of the Lower Parish in the Isle of Wight County in Virginia being sick in body but of perfect memory praysed be the Almighty God for the same do make this my Last will and Testament in manner and form as follows. Imprimis, I do hereby commit and bequeath my Soul unto my God and Saviour Jesus Christ through whose ___ I hope to obtaine Eternal Salvation, and my body to be buryed in a Decent Manner. Secondly, I give and bequeath unto my Daughter Olive Driver the wife of Giles Driver a parcel of land in the woods, being part of Divident lying on the Northeast side of the Swamp by the house, Eastward to the Poccoson, running up the side of the said Swamp and running Westerly up along by a Branch on the other side of the house to another little Branch called the Miery Branch and Sou extending to the bounds of Matthew Tomlin markt Trees and William West on the other sdie being part of a Divident of Land I tooke up by Patent, wch said parcel of Land I do hereby fully give unto her and such Heirs as she shall be pleased to give and bestow it to, Lawfully begotten, of her body, and their Heirs for Ever. Item, I give and bequeath unto my Daughter Lucy Councill, the wife of Hodges Councill, one parcel or Tract of Land on the South East of the sd. Branch or Swamp that the former Lands joyned unto Extending in it full bounds to the line of Wiliam West and so running up the Pocoson wch sd. parcel of Land I do freely give and bequeath unto her and to any of her Heirs Lawfully begotten of her body and to their Heirs for Ever. Item, I give and bequeath unto my Daughter Debora Hardy one parcel of Land lying and being about the house, beginning at the swamp formerly spoken of and running down the swamp to William West’s line and soe along the said line till it comes to Matthew Tomlins corner Tree and soe along the said corner Tree Tomlin’s line till it meets the Land of my said Daughter Olive Driver, wch sd. parcel or Tract of Land wth the house and edifices thereon now standing I do freely give and bequeath unto her and either of her Heirs lawfully begotten of her body and their Heirs for Ever, But in case my said Daughter Deborah Hardy should happen to dye without any Issue Lawfully begotten of her body, that then my will is and I do freely give and bequeath the sd. Tract of Land with the House and Edifices aforesaid unto my Grand Child Hardy Driver the Daughter of Giles Driver and to either of her Heirs for Ever. Item, My will is and I do hereby ordeyne and bequeath all the pocoson Land that belongs to the divident to be Equally divided for the said Tracts to find them Timber for the furnishing the Severall plantations thereupon as Occasion shall require for Ever. Item, I give unto my Son in Law Giles Driver one Draft brinded ox Called Swan. Item, I give and bequeath unto my Son in Law Hodges Councill One Serge Suit of my Wearing apparell and my Back Sword. Item, I do give and bequeath unto my Grand children, that is to say, my Daughter Olive Drivers two children, each of them one Ewe sheepe a piece with their increase, and to the three children of my Daughter Lucy Councill each of them a Ewe a piece with their increase to be delivered unto them presently after my Decease. Item, I give and bequeath unto my Wifes Grand Childe John Johnson one Cow, to be delivered unto him when he comes of the age of seventeene yeares. Item, I give and bequeath unto my well beloved loveing Wife Alice Hardy, my Debts and funerall expenses being first paid and satisfied, all the rest of my Worldly Estate of what nature quality or condition whatsoever during her life to be at her disposing and after her decease to be Equally divided between my aforesaid three daughters and whom she thinks fit of their Heirs, making her my whole and sole Executrix of this my Last Will and Testament. Item, I do give and bequeath unto my Son in Law Robert Burnett my Rapier and Belt, and unto William Mayo all my Silver Clasps to my Breeches and Shirt whome I shall request to see this my Last Will and Testament performed.
