JOHN WISHART, KING GEORGE COUNTY, VA WILL File contributed for use in USGenWeb Archives by Barry McGhee bmcghee@interserf.net To: cityslic@ix.netcom.com --------------------------------------------------------------- WISHART, JOHN Will: ( John Wishart died in 1774) In the name of God amen, I John Wishart Rector of the Parish of Brunswick County of King George and Colony of Virginia being weak in body but of sane and perfect mind and memory (blessed be God) do this [blank] day of [blank] in the year of our Lord Christ One thousand Seven hundred and seventy four, make and publish this my last will and testament in manner following Viz Imprimis: I give and devise unto my son William all that parcel, tract or tracts of land left to my wife Letica by the last will and testament of her uncle the deceased Col. William Rowley to him and his heirs forever, reserving to my said wife Letice the use occupation and enjoyment of the said lands during her natural life. Item whereas I am apprehensive that in case my said wife should marry again she may have a right to give the said land to children she may have by a second husband; therefore should she have such right and this do, then I give unto my said son William, the half of the land I purchased of John Grigg to him and his heirs forever. Item I give and devise unto my son Sidney , the other half of the land I purchased of John Grigg, to him and his heirs forever - But if my said Wife should confirm to my son William, all her right to the land left to her by her uncle aforesaid after her decease, in that case I give the whole of the land I purchased of John Grigg to my said son Sidney to him and his heirs forever. Item. I give and devise all my, all my slaves and personal estate to be equally divided between my sons William and Sidney and my daughter Wilhelmina to them and their separate heirs forever. Item It is further my will and desire that my said children shall not possess and enjoy any part of their fortunes until my younger son Sidney arrives to the age of twenty one years, or in case of his death before that time, until the youngest of the survivors of them arrives to that age. It is further my will and desire that my wife Letice keep possession of my whole estate while she remains a widow for the support of herself and the maintenance and education of my children under the directions of such persons as I shall hereafter appoint in conjunction with herself for the management of my affairs. Also it is my desire if both or one of my sons shall appear to have a Genius for learning then that they shall have a liberal education if my estate will afford it. Item. Moreover it is my will and desire that in case my son William after he has arrived at the age of twenty one years should incline to marry and settle in the world that then my exors. May give him the use and possession of so many slaves as they shall think fit until such time as the appointed division shall take place. But on this condition only that he marry with the consent of the Guardian or Guardians appointed by this my will and testament . And I do hereby constitute and appoint Messrs. Gowin Lawson, Arthur Morson, Thomas Hord and William Adie Exors Jointly with my said wife Letice Executrix of this my last will and testament. And Further appoint the said Gowin Lawson, Thomas Hord, William Adie and my wife Guardian to my Children. Hereby revoking all former wills and testaments by me heretofore made. In witness I have hereunto set my hand and affixed my seal the day and year first above written. John Wishart deceased was presented into Court by Thomas Hord, Gent. One of the Executors therein named who made oath thereto and proved by the witness and received and a Bond acknowledged. Cooke from a copy of the Will which can be found in a Suit Styled: Wisharts vs Murphy: Ended Year 1801/1802: Box CI-CR-DC-L: ID 564-61, in the Clerk's office in The City of Fredericksburg, Virginia. Although Great Care has been taken in this transcription to insure it's accuracy, it must be noted that this document does not constitute a legal record and should not be represented as such. (Note: The words "Viz Imprimis" are Latin terms. "Viz" translates "To-Wit" or "That is to say". "Imprimis" translates "First of All". The word "Item." Translates to "Also" or "In like manner", this word was sometimes used to begin a new paragraph or division after the first. Note: Either John Wishart did not fill in the date on this Will or The Clerk who made the copy for Court did not. In the suit is found a paper dated May 4'th 1802 signed by Michael Wallace in which he states that the Reverend John Wishart died sometime in the year 1774. ) n.b.
