Bertha Burton, Worley Ward, Dorothy Quinn, Earnest Ward, Parie Matney, Cecil Ward, Alice Bellamy, Emmett Ward, Dana Ward, Charley Ward, Ruby Ward, Edith Smith, Dora Million, Defendants; filed suit to partition the lands of John E. Ward, deceased. The dower tract was assigned to Maude Ward for and during her natural life, as and for her dower interest is described: Beginning at a beech (now dead) & buckeye (now gone) on the east side of Scott's Branch, thence down said branch as it meanders 1608 ft. to a stake corner to tract #1, thence with a partition line between the dower tract And Tract # _ S 87 45 W 2550 ft. to a stake (note, this is a plotted line, course may have to be changed should it not strike in the Johnson line or west boundary line at the point wanted; that is 400 ft from the stone N.W. corner); thence with the Ward & Rasnic line S 88 30 E 901 ft to an old black gum; thence N 47 45 E, passing planted stone at 30 ft corner to Rasnic & Young land, in all 716 ft. to stake on the ridge; thence N 51 20 E 1297 ft to the beginning, containing 41 acres more or less. Tract No. 1 was assigned to Dana Ward... and contained 7 acres more or less. Tract # 2 was assigned to Maude Ward and contained 14 acres more or less. Tract No. #3 was assigned to Emmit & Cecil Ward and contained 81 acres more or less. It was also decreed that Maude Ward do take and hold for her natural life, the dower tract, containing 41 acres more or less, with remainder in fee simple as follows: an undivided 1/14th to Dana Ward; and undivided 2/14 to Maude Ward; and undivided 11/14 interest to Emmett Ward & Cecil Ward; that the said Dana Ward take and hold in fee simple Tract # 1 of 7 acres; Maude Ward do take and hold in fee simple Tract # 2 of 14 acres; Emmett Ward & Cecil Ward do take and hold jointly in fee simple Tract No. 3 of 81 acres. It was further adjudged and decreed that the titles to the land of John E. Ward deceased shall vest in the person to whom the shares are assigned as set forth. It is further decreed that Maude Ward pay 2/14th of the cost of this suit; that Dana Ward pay 1/14th of the cost of the suit; that Emmett Ward and Cecil Ward pay 11/14 of the cost of the suit. Filed in the Clerk's Office on 8 September 1949. Additional Comments: Maude Ward received the 41 acre Dower Interest that included the house of John E. Ward and the cemetery where he is buried, off Road # 52 which goes to Jasper and across from the land of Howard Edwards. Dana Ward received a long narrow tract between Maude's dower tract and her 14 acres which represented her 2/14th (1/7th) interest. Emmett Ward an Cecil Ward's 81 acre tract was along the road off Road # 52. bordered by W. A. Johnson, G. W. Smith, an Maude Ward. Sometime later someone burned the home place on Maude Ward's dower tract to the ground.
