Persons or organizations desiring to use this material for non-commercial purposes, MUST obtain the written consent of the contributor, OR the legal representative of the submitter, and contact the listed USGenWeb archivist with proof of this consent. ****************************************************************** Deed Bk 10 496 This Indenture made this 16th day of June 1846 between between William Cole and Isaac Cole of the county of Lee and the state of Virginia of the one part and Henry S Kane of the county of Scott and State aforesaid on the other paret witnessth that whereas the said William Cole & Isaac Cole is justly indebted to David R Kane in the sum of fifty dollars due the 15th of this present month ( by note) and the said William COle and Isaac Cole being willing and desirious to secure the same and for in consideration of one dollarin hand paid by the said HS Kane ? to the said William COle and Isaac Cole , they the said William Cole and Isaac Cole doth grant bargain sell and convey unto the said Henry S Cane one white milch cow, and calf, and two cows, about 18 head of stock hogs, and riffle gun, 3 plows and ? together with all the other farming utensils, of the said William Cole, all the household and kitchen furniture of the said William Cole, consisting of bedsteads, bedding, all of the oats and corn crop, now growing, and in the fields of the said Cole, ? more the property of the said Isaac Cole, ans fifty acres of land of the said Isaac Cole situated in the said county of Lee lying and being on the waters of Stone Creek, it being the same landthat the said Isaac Cole got in exchange from land from Bemjamin Dickinsonand from which he holds said Dickenson's title bond from a right to the same together with any other real estate of the said Isaac Cole now has inb the county of Lee or elsewhere to have and to hold the said personal property together with the increase ? thereof and the said tract of land with the appurtenances thereonto belonging to him to the said Henry s Kane together and his heirs clear from the claim or claims of them the said Willaim Cole and Isaac Cole and their heirs foreever . In truth? witnessth? if the said William Cole and Isaac Cole or either of them shall well and justly pay or cause to be paid unto the said David R Cane the said sum of fifty dollars and with the legal interest thereon and the expenses of drawing and recording this indenture on or before the 15th of September 1848 together with the legal commision to HS Cane trustee aforesaid then the above obligations to be void otherwise it shall be lawful by the said Henry S Cane after giving 20 days notice of the time and place of sale by putting up an advertisement from that space of time at the front door of the courthouse of Lee county offer for sale at public auction for cash in hand to the highest bidder the aforesaid person and real estate as herein mentioned or so much thereof as shall be sufficient value to satisfy the said sum of fifty dollars and interest , the expenses of drawing and recording this indenture, and 5 percent to said trustee, the overplus if any after paying the fifty dollars and interest due the said DR Cane, and the expense of drawinf up and recording this indenture to pay over to said William and Isaac Cole.In witness to which the parties have hereunto subscribed their names and affixed their seals. the day from first above written.
