Excuted 4 June, 1794, codicil executed 28 March, 1797, proved 9 February, 1801. Recorded Loudon Co., Va., Will Book F, p. 228. [Peter Carter's father may have been Job Carter, b. ca. 1700, d. ca. 1752, Fairfax Co., Va. Peter married twice: 1) Amelia Veale, dau. of Morris Veale. With her, he had: John, Edward, Morris Veale, Lettice and Amelia; his 2nd wife was Hannah Whaley, dau of James Whaley, Sr. and Hannah Higgerson. With Hannah he had: Ephraim, Elam, Elihu, James, Mary, Elizabeth, Ann and Frances]. In the name of God Amen. I Peter Carter of the County of Loudon and Parish of Cameron in my perfect senses make this last will and testament. Imprimis Unto my loving wife Hannah Carter one moiety of my plantation & tenement whereon I now live with the houses to be included in her moiety and one half the orchard, for and during her natural life provided the term by which the said tenement should continue so long; likewise unto my said wife Hannah during her life the use of my two negroes Townsend & Pigg, also for & during her natural life I give her the use of such of my beds as she may wish together with their furniture, also it is my wish and desire that my said wife Hannah should keep the stock of animals together & in her possession excepting those parts thereof otherwise bequeathed unto my children on her begot should arrive to the age of twenty one or marriage. Item I give bequeath to my loving son John Carter the other moiety of my tenement & plantation to him and his heirs provided he continues to reside on the same but in case he shall leave and quit the same or sell it then and in such case my will and desire the last mentioned moiety of my said plantation should return to my wife aforesaid and be hers to be held & possessed for the use of herself and such of her children as are by me begotten. It is my meaning and desire that my son John in his moiety shall have included the half of the orchard not bequeathed to my wife Hannah. Item I give to my son John Carter my negroe wench Judith and my negroe fellow Harry to him & his heirs forever, but in case he should die without leaving heirs of his body living at the time of his death then and in such case I bqueath and desire that the said negroes Judith & Harry shall together with their increase be equally divided between my son Edward and my daughter Melia [Amelia] Moss to them and their heirs forever. Item I give unto my son John two cows and four head of sheep a second choice of one bed and furniture. Item I give to my son Edward Carter my negroe fellow Joseph to him & his heirs forever. Item I give to my son Morris Veale Carter little Rachel & George also a third choice of a bed and furniture two cows & four sheep, the whole I mean for him and his heirs provided he has heirs of his body living at his death but in case he has no such heirs living at his death then and in such case I bequeath the said two negroes and other property hereby bequeathed to my son Morris, unto my son John Carter and Lettice Whaley to be equally divided between them and their heirs forever. Item I give unto my son in law James Whaley and his heirs the negroe boy Aaron now in his possession. Item I give unto my son in law Thomas Moss & his hers the negroe wench Mall & her increase now in his possession. Item I give unto my son Ephraim Carter & his heirs my negroe wench Rachael & her future increase. Item I give unto my son Elam Carter and his heirs my negroe boy Jack. Item I give unto my daughter Molly Carter and her heirs my negroe girl Patty and her future increase. Item I give unto my son Elihu Carter and his heirs my negroe boy Mace. Item I give unto my son James Carter and his heirs my negroe boy Sam. Item I give to my daughter Elizabeth Carter & her heirs my negroe girl Mary Ann. Item my will and desire is that my negroe wench Frank should remain on the plantation to assisting [sic] in raising the children. Item my will and desire is that after my wife's death that negroe Peg shall go & be owned & possessed by my youngest child by the name of Ann. Item my will & desire is that after my wife's death that all the property bequeathed unto my wife as aforesaid except negroe Peg shall be equally divided between & among her children by me begotten. Item I hereby appoint my loving wife guardian of her children aforesaid. Lastly, I constitute and appoint my loving wife & John Carter Executrix and Executor of this my last will and testament in Testimony whereof I have hereunto set my hand and seal this 4th day of June in the year of our Lord 1794.
