And it is considered by the Court that the plaintiff recover against the said Defendant his Damages aforesaid in form aforesaid assessed and also his cost by him and his Suit in this behalf expended. Zenas Tait, Plaintiff against John Marshall, Defendant In Case Continued 'til the next Court -Zenas Tait Plaintiff against Dudley Brown, Defendant In case Continued 'til the next Court. -James and Thomas Pulliam, Plaintiffs against William Garrett and Thomas Wit, defendants In Debt Upon Bond And now at this Day came the parties by their Attornies and thereupon a jury to wit James Michie and eleven other, who being Impannell'd and sworn well and truly to try the matters in issue joined withdrew and in a short time returned the following Verdict "We find for the plaintiff against the Defendant according to Bond five pounds seventeen shillings James Michie, Foreman" which on the plaintiffs motion is recorded. Therefore it is considered by the Court that the plaintiff recover against the said Defendants the said five pounds seventeen shillings and also their Cost by them and their suit in this behalf expended. And the said Defendant in mercy and c. Louisa County Court 13th of March 1770 -James George, Plaintiff against John Richmond, Defendant Petition By consent of the parties by their Attornies all matters in difference between them are referred to the determination of William Phillips and Thomas Ballard Smith, Gentlemen whose award is to be taken and made the judgment of the Court and the same is ordered accordingly. -Robert Adams, Plaintiff against Matthew Johnson, Defendant Petition Continued 'til the next Court. -William Robinson, Plaintiff against Thomas Mountague, Defendant In case Continued 'til the next Court. -John Elliot Paine, Plaintiff against Isaac Spencer, Defendant In Debt Continued 'til the next Court -Andrew Cockran, Robert Donald and Co. Plaintiffs against William Cosby, Defendant In case And now at this Day came the parties by their Attornies and thereupon came also a jury to wit George Brown, David Wood, James Tait, David Terry, James Watson, William White, Nathaniel Anderson, William Hogan, William Bigger, William White (capt), David Humphries and Thomas Freeman who being elected tried an sworn the truth to speak upon the issue joined upon their oaths do say that the Defendant did assume in manner and form as the plaintiffs in their Declaration against him hath complained and they do assess the plaintiff Damages by occasion of the Defendants non performance of the assumption to Twenty five pounds Current Money besides their Costs. Therefore it is considered by the Court that the plaintiff recover against the said Defendant their Damages. (No date) -James Mitchell and Mary his wife she being first privately examined acknowledged their deed for Land to Dabney Minor which is admitted to record. -John Marshall came into Court and Entered himself security for George Lumsdon costs and c. in a suite depending between him and Nathaniel Pope, Gent. Sheriff. -Thomas Clark, deed for Land to Francis Clark was proved by the oaths of Thomas Clark, Jun., Francis Clark, Jun. and John Clark, Jun. three of the witnesses thereto and is admitted to record. -On the motion of Lawrence Young, It is ordered that the Sheriff keep the money in his hands on an execution Stanfield v. Young untill the next Court. Louisa County Court 11th of February 1771 -Edward Power and Others Executors of John Power, Deced. Deed for Land to John Jouett was proved by the Oaths of Anthony Thomson, Matthew Jouett and John Timberlake witnesses thereto and is admitted to record. -The same persons Deeed for Land to Waddy and Anthony Thomson was proved by the oath of John Timberlake, Matthew Jouett, and John Jouett and is ordered to be recorded. -The same Persons Deed for Land to Zachariah Hogan was proved by Witnesses and is ordered to be recorded. -Present Richard Anderson, Gent -Robert Anderson, Gent acknowledged his Deed of Sale to the Reverend Robert Yancey which is admitted to record. - John Nelson acknowledged his Deed for Land to John Woodlief which is admitted to record. - Ordered that William Smith do serve as overseer of a road in the room of Hnery Gambrill. - Ordered that Samuel Bunch, Charles Sanders, Robert Beaver, Francis Fidler, Harry Taylor, David Humphrys, John Glasbe and Phillip Reynolds male tithables be added to William Reynold's gang on the Three Chopt Road. -Ordered that John Anderson's, Mrs. Chamberlayne's, John Hargoes's, Samuel Waddy's, John Waddy's, John Stewart's, George Johnson's, John Fox's, James Gibson's, Bartelot Anderson's and Susanna Fox's Male Tithables do serve under John Fox as overseer of a road. - Ordered that John Garth serve as Overseer of the road from the County Line to the old road and that the hands of Love Statam, John Thacker, Nathaniel Thacker, John Price, Stephen Hunter, John Perkins, and John Humphry's do serve under him and that Robert Fleming Bibb keep the said road in repair from the Old road to the river bridge with his own hands Mr. Henry's and the same hands of Thomas Johnson, Gent. as he had before and John Richmond's. -Ordered that the order of the last Court for adding hands to John Walton, Jun. as Overseer of a road to be reversed. Louisa County Court 11th of February 1771 -On the Complaint of Mary Gardner a Mulatto woman held as a servant by John Richmond the Court having considered the same do order that she be set at liberty the said Richmond failing to appear when called and it appearing that she is no servant. Ordered that the Court be adjourned till the Court in Course. The minutes of these proceedings were signed. Thomas Johnson At a Court held for Louisa County at the Courthouse on Monday March the Eleventh in the Eleventh year of the Reign of our Sovereign Lord George the Third by the Grace of God and Great Britain France and Ireland King Defender of the Faith and so Forth and in the year of our Lord 1771. -Present his Majesties Justices Robert Anderson, James Overton, Samuel Ragland, Waddy Thomson and William Phillips, Gentlemen -Archibald McCall, Plaintiff against Clevears Duke, Defendant In Case This suit is ordered to be tried at June Court next and the Defendant is to give the plaintiff notice thereof. -Neil McCoul, Plaintiff against Clevears Duke, Defenant In Case The same order. -William Duval came into Court and took the Usual Oaths to the Government and Subscribed the Test. and Abjuration Oath and also took the Oath of an Attorney. -Clevears Duke acknowledged his Deed for Land to John Duke which is ordered to be recorded. -The same acknowledged his Deed for a Negroe to Burnley Duke which is ordered to be recorded. Louisa County Court 11th of March 1771 -David Davis, Plaintiff against Bartelot Anderson, Defendant In Trespass Assault and Battery This suit is Dismist the Plaintiff paying all costs. -John Bigger is excused from being fined for not appearing on the Pettit Jury. -Ordered that James Robinson and William Thomson Overseers of Roads with their Gangs do join and Open the road form Brock's Bridge to Doctor Walker's new road. (no date) right before entry for Nov 13, 1769 -The Last Will and Testament of John Watkins, Deceased was exhibited in Court by Isham Watkins one of the Executors therein named, who made oath thereto as the Law Directs, and the same being also duly proved by the oaths of William Rice and Thomas Jackson, two of the Witnesses thereto is admitted to record, and on the said motion of the said Isham Watkins and his performing what the Law in such cases require, a Certificate is granted him for obtaining thereof in due form. Louisa County Court 13th November 1769 -Isham Watkins and Moses Gentry acknowledged their Bond for the said Watkins his due execution of the Last Will and Testament of John Watkins, Deceased which is ordered to be recorded. -On the motion of Walter Mosely a Witness for Andrew Greenhorn against George Holland; 'tis ordered that the said Andrew pay him for his attendance at this Court six days and coming and returning. Thirty miles six times as the law directs; six hundred ninety pounds of tobacco. -A deed poll from Joseph Street to John Marshall was proved by the oath of Charles Barret one of the Witnessed thereto, who also Declared on oath that he saw George Lumsden subscribe the same as a Witness and ordered to be recorded. - A Letter of Attorney from Joseph Street to George Lumsden was proved by the oath of John Nelson and John Lewis Witnesses thereto and admitted to record. - A note being produced in Court under the Hands of Phillip Williams and Joseph Perkins desiring that judgment might be entered against them in favour of Andrew Cockran and Company for a Debt to them due from the said Phillip by a former judgment of this Court staying Execution 'til Christmas next, Therefore with the assent of the said Andrew Cockran and Company by their Attornies it is considered that they recover against the said Phillip and Joseph nine pounds seventeen shillings and seven pence Current Money with Legal Interest thereon from the sixteenth Day of September 1765 'til paid, and fifteen shillings or one hundred and fifty pounds of Tobacco and one hundred and Twenty six pounds of Nett Tobacco the amount of the judgment formerly obtained against the said Phillip and also their Costs in this behalf expended. - On the motion of James Chiles a Witness from Spotsylvania for David Terrill against Thomas Johnson; 'tis ordered that the said David pay him for his attendance at this Court thirty two Days and for coming twenty five miles twenty four times and returning according to Law, Two thousand five hundred and forty pounds of Tobacco. - An Indenture of Lease between Jeduthon Harper of the one part and John Jones of the other part, was proved to be the act and Deed of the said Jeduthon by the oath of Matthew Jouet. Williams, who also made oath that he saw James Herndon and John Thomason subscribe the same as Witnesses and on motion of the said Jones admitted to record. - An Indenture of Bargain and Sale between Henry Duke and Anne his Wife of the one part and William Donald of the other part was proved by the oaths of John Brown and Richard Anderson Jr., two of the Witnesses thereto and ordered to be certified. - An Indenture of feoffment between Alexander Glasby and Ann his wife of the one part and David Bibe of the other part with a Memorandum of Livery and Seisen and Receipt thereon endorsed were proved by the oaths of John Rees and William Rennolds two of the Witnesses thereto. - Ordered that Thomas Jackson, William Rice, James Nucholls and Cornelious McCoy or any three of them being first duly sworn appraise in current Money the slaves (if any) and personal Estate of John Watkins, Deceased and return the appraisment thereof to Court. - George Thomason and others, Complainants against Isbell Flemng et al Defendants In Chancery On the motion of the Complainants by their Attorney leave is given them to amend their Bill, they paying the Cost. - Ordered that Robert Anderson, Thomas Johnson Jr., and William Phillips, Gentleman do audit, state and settle the administration of the Estate of Gilbert Gibson, Deceased in the Hands of Sarah Gibson Administratrix, and Thomas Freeman and return the said Settlement to Richard Cole is appointed Surveyor of the highway in the room of William Hendrick and it is ordered that he keep the same in repair according to Law with the Hands alloted the said William. - Ordered that the labouring Male Tithables belonging to James Melton, Gideon Harris, Richard Henson, William Sears, Anthony Golson, John Harris and John Sutton (at his Quarters in this County) be added to John Buyars Company to work on the Road whereof he is overseer. - The persons appointed to procession the bounds of the Lands between Sarah Freeman and John Dicken having certified that the said Sarah refuses to have the same procession. It is ordered that the Surveyor of this County in Company with a jury (to be summoned by the Sheriff) lay out and procession the bounds of the Lands in Dispute between the said parties as the Law directs and make report to the next Court, and the Sheriff is to attend the said Survey to remove force if any shall be offered. - The Last Will and Testament of John Tait was further proved by the oath of James Hill a Witness thereto and admitted to record. - David Cosby came into Court and made oath that he has attended this Court twenty six days as a Witness for William Cosby against Sir William Bickley -Ordered that the Sheriff of this County summon Samuel McGehee, Thomas Wash, Cosby Duke, Joseph Boxley, John Moss, William Fleming, Zachariah Tait, David Humphries, David Gentry, David Shelton and Peter Hunter to appear at the next Court to show cause why they did not attend this Court as Grand Jury men. Louisa County Court 14th of October 1771 -The last Will and Testament of Thomas Paulet, Gent. deceased was presented in Court by William Paulet one of the Executors therein named who made oath thereto according to Law and was proved by the oaths of William Trimmer and Elias Thomasson the Witnesses thereto and ordered to be recorded, and the said executors having given bond a certificate is granted him on due from for obtaining a probate thereof. -Ordered that Richard Phillips Sen., Richard Phillips, Jr, William Lipscob and Samuel Thomasson or any three of them being first sworn do appraise the Estate of Thomas Paulet, Gent. deceased and report to Court. -John Bradley is appointed Constable in the room of Drury Pulliam. - Ordered that the Court be adjourned till tomorrow morning 10 o'clock. Thomas Johnson At a Court continued and for Louisa County November 12, 1771 Present Thomas Johnson, William Phillips, Robert Anderson, Samuel Ragland and William Garrett, Gentlemen Justices -Ordered that Captain Samuel Ragland's Hands be added to Curtis Parrot's Gang and that they be discharged from working on any other road and that John Bickley's, Charles Hester's and William Washe's hands be added to the said gang. -An indenture from West to Isbel acknowledged by Mrs. West (she being first privily examined as the law directs) and ordered to be recorded. -On the motion of William Shelton, Guardian Hopkin's Orphans, Its ordered that the Sheriff take Negro Jenny and her children now in the possession of Isaac Freeman and detain them in his possession for the said Shelton until the said Freeman can give bond and security not to remove the said slave out of this Colony. Ordered that the Hands under James Robinson and William Thomson open the road form Bradbun's Ford to uper Church in Trinity Parish. P William White, Jun. -Angus Magine being committed to Goal on suspission of being a runaway servant and remaining therein for the space of one month and no owner appearing and upon examination of the said suspectedperson it appearing to this Court that he is not a runaway servant, Its therefore orderd that the Sheriff set him at Liberty. P Waddy Thompson, Gent. -Ordered that John Estis be added with Waddy Thompson, Gent. in the sale of Mortgage'd land from Estis to Thompson. - Anthony Thompson is appointed surveyor of the road in the room of Turner Patterson and it's ordered that he keep the same in lawfull repair. - A Mortgage from William Phillips, Gent. to Andrew Cockran and Co. Acknowledged by the said William and ordered to be recorded. - Richard Anderson, Gent. Plaintiff against William Pettit, Defendant In case This suit is dismissed at the plaintiffs costs. - James Minor, Complainant against John Mansfield, Defendant In Debt The auditors report being returned in these words "In obedience to an order of the worshipfull Court of Louisa County, we the subscribers have settled all matters in Difference between James Minor, Plaintiff and John Mansfield, Defendant and find the Ballance due from the said Defendant to the said Plaintiff to be twenty three pounds five shillings current money which sum we award the said James Minor together with lawfull interest from the date hereof till paid given under hands this 12th day of November 1771, Thomas Johnson, Robert Anderson, William Phillips, Therefore it is considered by the Court the plaintiff recover the same and also his costs in this suit expended. - -Then the Court proceeded to lay the County Levy To DTo LSP John Nelson Law 1248@9 10.8.0 The Sheriff as ditto 1248 10.8.0 Richard Johnson for keeping the Court House 1250 10.8.4 John Lewis, King's Atty 2000 16.13.4 William Trimmeer for 3 post of Direction 00.15.0 Richard Johnson as Acct 581 4.13.10 William Thurston for 8 Tithes overpaid in 1769 0.10.0 Stephen Hunter for patroling 1.0.0 Bartelott Hailey for ditto 0.10.0 David Humphrey for ditto 0.3.4 John Glasby for ditto 0.3.4 Turner Patterson for 4 posts of Direction 0.15.0 Curtis Parrott for 2 ditto 0.3.9 The Secretary as Acct. 182 1.13.4 John Nelson as ditto 154 1.5.8 James Travilion for 2 posts diretion 0.7.6 Maj. Thomas Johnson for building a bridge 4.0.0 Louisa County Court 10th April 1770 -At the motion of James Gibson he is allowed thirteen days attendance as an evidence summoned by John Snelson against Davis. This ordered that the said Snelson pay him three hundred twenty five pounds of tobacco for the same as the law directs. -Ordered that John Snelson pay Jemima Gibson for seven days attendance as an Evidence for him against Davis one hundred seventy five pounds of Tobacco as the law directs. -At the motion of George Baker a Witness summoned from Hanover County for John Snelson against Davis. It is ordered that the said Snelson pay him eight hundred forty pounds of Tobacco for the same as the law directs. -John Watson, Plaintiff against Edmund Fostor, Defendant in Debt This day came the plaintiffs by his attorney and the Defendant altho solemnly called came not, and the court having heard the Evidence are of Opinion that six pounds current money with lawful interest thereon from the first day of September 1766 until paid is due to the plaintiff. Therefore it's considered by the Court that the plaintiff recover of the Defendant the same and his costs in this behalf expended and the said Defendant in Mercy and c. (Memo 40 s paid by receipt on the Bond.) - At the motion of David Humphrys he is allowed for Nine days attendance as an Evidence summoned by William Colvard against Terry. It is ordered that the said Colvard pay him Two hundred twenty five pounds of Tobacco for the same as the law directs. Louisa County Order Book 1760-1774 Louisa County Court 12th of July 1773 -Ordered that James Minor pay Samuel Hartgrove for one days attendance and coming and returning forty miles as a witness for him at the suit of Richard Goodall, Administrator, as the Law directs one hundred and forty five pounds of tobacco. -Ordered that James Minor pay John Jones for one days attendance and coming and returning forty five miles as a witness for him against Richard Goodall, Administrator, as the Law directs one hundred and sixty pounds of tobacco. -Ordered Richard Goodall pay William Quarls and Willaim Goodall for one days attendance and twice coming and returning forty miles as a witness for him against James Minor as the Law directs two hundred and ninety six pounds tobacco each. -Richard Harvie and Co. Plts against Patrick Michie, Deft. in Case Judgment is confessed by the Defendt. for thirty one pounds, eighteen shillings, and one penny three farthings with Interest thereon from the 1st of September 1772 till paid and also the cost of this suit, all discounts to be allowed that are made appear at the next Court. -Ordered that Richard Harvie and Co pay Reuben Lindsay for two days attendance and twice coming and returning eighteen miles as a witness against Patrick Michie as the Law directs one hundred and fifty eight pounds of tobacco. -Ordered that Richard Harvie and Co pay Hastings Marks for two days attendance and twice coming and returning thirty three miles as a witness for him against Patrick Michie as the Law directs two hundred and forty eight pounds of tobacco. -On the motion of William Terrill, it is ordered that Francis Bickley shall settle the Guardianship of his Brother, James Bickley's estate and it is ordered that George Pottie, William Anderson, John Marshall, and William Johnson or any three of them do audit and settle the same and return an Account thereof to the next Court. - William Anderson, Plt. against James Taylor Deft. Upon an attachment Judgment is granted the Plt. in the hands of Lewis Walden for two pounds with Interest thereon from the 25th day of December 1772 till paid (due by bond) also the further sum of two pounds, two shillings, and four pence half penny (due by account) and also the costs of this suit, the money to be paid the 10th day of May next ensuing. -Upon the Petition of John Payne, Gent. against David Humphrey, judgment is confessed by the Deft. for one pound, eleven shillings and seven pence and the cost of this suit. -Ordered that John Payne, Gent. pay William Lewis and Samuel Sheets for one days attendance and coming and returning fifteen miles as witness for him as the Law directs seventy pounds of tobacco each.
