The submitter has given permission to the USGenWeb Archives to store the file permanently for free access. http://www.usgwarchives.net ************************************************************************ Transcript of Louisa County Deed Book A, page 262: Hardy's Deed to Darwin [transcribed by Tim Darwin Grana, 1992] Hardys deed to Darwin THIS INDENTURE made this thirty first day of October in the year of our Lord one Thousand Seven hundred and forty Six BETWEEN Thomas Hardy of the County of Louisa of the one part and William Darwin Junr of the County aforesd of the other part Wittnesseth that the said Thomas Hardy for and in consideration of the sum of fifteen pounds current money to him in hand paid before the ensealing and Delivery of these Presents the receipt whereof he doth hereby acknowledge and himself herewith fully Satisfied contented and paid and of Every part and parcole thereof the said William Darwin his heirs Ex'rs and Administrators doth hereby fully clearly and absolutely acquit and Discharge Hath Given Granted Bargained and Sold and doth by those Presents Gives Grants Bargain and Sale unto the said William Darwin Junr his heirs Ex'rs Admtrs or assignes for Ever one Certain tract or parcele of Land Sichuate Lying & being in the County aforesaid containing One Hundred acres only William Darwin and Jean his wife shall have their Lives in the said one hundred acr's of Land or the Longest Liver of these, which said Land is bounded as followeth to wit Beginning at John Taits corner pine in John Waltons Line, Running thence on Taits Line south eighty nine degrees East One hundred and ninety seven poles to a corner hickory sapling in his Line, thence south twenty eight and a half degrees West dividing this Land from the Residue of the said Hardys Tract one Hundred and eighty eight poles to a corner of Several marked Trees in Waltons Line, thence on his Line North thirty three degrees West One hundred ninety Seven poles to the beginning, which said One Hundred Acr's of Land in part of Patent Granted to the said Thomas Hardy for four Hundred and Nineteen acr's bearing date the first day of August one Thousand Seven Hundred and thirty four Relation being thereunto had will more fully appear TO HAVE AND TO HOLD the aforesaid One Hundred acr's of Land with all Houses Orchards Gardens Woods, Underwoods, Ways, Waters, and Meadow Grounds, with all and Singular other the Premises and appurtenances thereunto belonging or in any wise appertaining from the claim right or Title of him the said Thomas Hardy his heirs Ex'rs Administrators or assigns or any other person or persons whatsoever to the only proper use and behoof of him the said William Darwin Junr (after the decease of the aforesaid William Darwin Senr. and Jean his wife) and the said Thomas Hardy doth for himself his heirs &c. covenant promise and agree that he will from time to time and at all times forever against all persons whatsoever, the Right of the abovesaid land & Premises will warrent and for ever defend. This Indenture Memorandum of Livery of Seisin Receipt were this day in open Court proved by the oaths of Charles Smith Benjamin Brown John Weatherford witnesses thereto & by the Court admitted to record & is recorded. 1 The date is Old Style, whereby January 1746 comes after October 1746 [TDG]. Submitted by Tim Darwin Grana EDWARD AND ELIZABETH LANE SELL 400 ACRES TO THOMAS POINDEXTER FREDERICKSVILLE PARISH, LOUISA COUNTY, VA P-347 & 348 This indenture made this 27th day of June in the year of our Lord one thousand seven hundred and forty-nine between EDWARD LANE AND ELIZABETH HIS WIFE OF THE PARISH OF FREDERICKSVILLE AND COUNTY OF LOUISA of the one part and THOMAS POINDEXTER of the said parish and county of the other part. The aforesaid hath paid EDWARD LANE AND ELIZABETH HIS WIFE for and in consideration of the sum of seventy pounds current money of Virginia to have by the said THOMAS in hand paid before his assigning and delivery of these presents. The receipt whereof they do hereby acknowledge there of every part, acquire and discharge being the said THOMAS his heirs and assigns for ever, have granted, bargained, sold, aliened, conveyed and confirmed and by these presents do grant, bargain, sell, alien, release, convey and confirm unto him the said THOMAS POINDEXTER, his heirs and assigns forever one certain parcel of land situated, lying and being on the FORK OF THE LITTLE RIVER in this parish and county aforesaid. Containing four hundred acres more or less and is bounded as follows to MR. BENJAMIN BROWNS corner, shrubby White Oak in DUMAS'S LINE, along the said BROWN'S LINE , South sixty-nine, North one hundred fifty-eight poles to his shrubby White Oak, thence South eighty-seven and North one hundred poles to a shrubby White Oak in the said line, thence South twenty-two and a half, East two hundred and sixty poles to a corner of several marked trees in the FORK OF ROCKY BRANCH, thence North sixty-nine, East three hundred and twenty-seven poles to four White Oaks by ROCKY BRANCH in the said DUMAS'S, thence along his line North forty-one, West thirty-five poles to a corner White Oak thence North seventy-six, West eighty-two poles to a corner Red and White Oaks, thence North twenty-two and a half, North one hundred and forty-five poles to the beginning with all buildings, houses, orchards, woods, ways, water, under woods and meadow, grounds and all and singular the improvements and appurtenances to the said land and premises belonging or in any wise appertaining and his division and remainder and pertaining hereof and all his right titled property whereof claim and command of these paid EDWARD LANE AND ELIZABETH HIS WIFE being the same or any part thereof. To have and to hold the said FOUR HUNDRED ACRES OF LAND above bounded and all and singular the possession with the appurtenances unto the said THOMAS POINDEXTER , his heirs and assigns forever, to the only proper use and behalf of him the said THOMAS POINDEXTER for his heirs and assigns forever. The said EDWARD AND ELIZABETH therefore acknowledge their heirs, executors and covenant, promise and agree to and will the said THOMAS POINDEXTER for his heirs and assigns that they will from time to time and at all times forever assigns, warrant and convey the right title and property of the said land and premises with the appurtenances unto the said THOMAS POINDEXTER his heirs and assigns forever free and clear of and from all forever land deeds, gifts, grants, bargains, sales, downers or titles of court judgment, executions or any encumbrance what so ever, the _______ heretofore conveying land to our sovern lord this being his heirs and successors only being possessed, whereof the said EDWARD AND ELIZABETH LANE hereunto set their hands and seals.
