Will of Thomas Wright, 1840 - Louisa Co. VA Louisa County Court Oct 17th 1840 In the name of God, Amen, I Thomas Wright of the County of Louisa and the State of Virginia being weak and infirm in bed, but of sound and disposing mind and memory do make and ordain my last Will and Testament as follows Item 1st. It is my wish that my negro woman America and her youngest child be sold by my executrix or executor for the purpose of paying my just debts. Item 2 It is my wish that my wifes mother be supported by my estate during her natural life, whether she should live longer than my wife or not. Item 3 I give to my son William Henry Wright when he arrives at the age of twenty one years a negro boy named Rueben. Item 4 I give to my son James Morriss Wright when he arrives at the age of twenty one years a negro boy named Jesse Price. Item 5 I loan to my wife during her natural life or widowhood all the land, negros and other property which may be in my possession at the time of my death accept so much thereof as may be sufficient to pay all my just debts and the negro boys given to my sons. Item 6 Should my wife wish to dispose of my lands for the purpose of investing the proceeds a rising from the sale in other land for the benefit of my estate she is hereby authorized to do so. Item 7 Should my wife marry again It is my wish that she have only one third of my estate during her life. Item 8 If the death of my wife, I give a bequeath all my estate of every description to my sons William Henry and James Morriss Wright to be equally divided between them taking into account the negro boys here to fore given them, so as to make them equal provided either of said negro boys should die before they get them in possession. Item 9 I hereby appoint my wife Sarah Wright executrix and my friend Hezekiah Sims executor to this my last Will and Testament requesting that they may not be required to give security. Thomas Alexander Bagby At the Court of Quarterly Session held for Louisa County at the courthouse thereof on Monday the 9th day of November 1840. The last Will and Testament of Thomas Wright dec’d was this day exhibited listed in open court and was proved by the oaths of Thomas Rutherford, James M. Thomas & Alexander Bagby subscribing witness there to & by the Court is ordered to be recorded. And on the motion of Sarah Wright the executrix named in the last Will and Testament of Thomas Wright dec’d who made oath according to law and entered into and acknowledged a bond in the penalty of Nine thousand dollars conditioned as the law directs a certificate is her for obtaining a probat of said Will in due form, she being permitted by the Court to qualify without giving security according to the terms of the said Will & liberty is reserved to the Executor named in said Will to join in the probat hereafter if he thinks proper to do so.
