This Indenture made the 1st day of February one thousand eight hundred
and Seventeen, between Paschal Early Sheriff of the County of Madison and
State of Virginia of the one part, and Elijah Yowell of the County and State
aforesaid of the other part. Whereas by virtue of an act of Assembly intitled
"an act to amend and explain the act intitled an act concerning taxes on Land"
passed the ninth day of February one thousand eight hundred and fourteen.
Nathaniel Welch late Sheriff of the County of Madison, did at the August Court
for the County aforesaid, in the year one thousand eight hundred and fifteen,
sell at publick sale a tract of Land in the said County of Madison entered or
standing on the Commissioners book as the land of John Yowell containing three
hundred hundred [sic] acres, for the -------- of taxes and damages upon the
said Land so returned delinquent in the name of John Yowell for the year 1801,
2, 3 and so amounting to four dollars and forty one cents inclusive of the
damages added thereto for the non payment of said taxes, at which sale the
said Elijah Yowell became the purchaser of the said tract of Land, so returned
Delinquent, in the name of John Yowell, at the price of four dollars and forty
one cents, but before the conveyance of the said land to the said Elijah
Yowell according to the before recited act of Assembly, the said Nathaniel
Welch departed this life, whereby and by virtue of an act of Assembly passed
at the session 1815 the duty to convey lands so situated devolved on the
successor in this office to such Sheriffs as shall have died before they shall
have conveyed the lands sold as aforesaid by them. Now this Indenture
Witnesseth that the said Paschal Early successor in the office of Sheriff to
Nathaniel Welch, for and in consideration of the sum of four dollars and forty
one cents by the said Elijah Yowell to the said Nathaniel Welch in hand paid
and for the further consideration of the sum of one dollar by the said Elijah
Yowell in hand paid to the said Paschal Early the receipt whereof is hereby
acknowledged. The said Paschal Early Sheriff in the execution of his duty and
on behalf of the Commonwealth hath conveyed and by these presents doth convey
unto the said Elijah Yowell and his heirs the said tract of Land aforesaid
with its appurtenances, containing as aforesaid three hundred acres. To have
and to hold the said tract of Land with its appurtenances to him the said
Elijah Yowell his heirs and assigns forever, but it is expressly by --------
and agreed between the parties to these presents, that ------- the said
Paschal Early --- the Commonwealth shall be answerable for the title of said
Land, but the said Elijah Yowell ---- and receive the same, in the same
Condition and -------, and with the same rights and titles as the said John
Yowell, in whose name it was returned delinquent, held it at the time it was
so returned delinquent. In Testimony whereof the said Pascal Early Sheriff
has hereunto put his hand and affixed his seal the day and year first above
written.

At a Court held for Madison County the 12th day of June 1817.
This Indenture of bargain and sale between Paschal Early Sheriff of
Madison County of the one part and Elijah Yowell of the other part, was
produced into Court and acknowledged by the said Paschal Early and ordered to
be recorded.
