Witnesseth that whereas the said Paschal J PENN is justly indebted to the said Joseph H KEELING in the sum of seventy five dollars and 95 cents and by bond, and whereas the said William W JOHNSON is justly indebted to the said Joseph H KEELING in the sum of forty eight dollars and forty cents, and whereas also the said Paschal J PENN being willing and anxious to secure the aforesaid Joseph H KEELING the said sum of seventy five dollars & 95 cents, and whereas also the said William W JOHNSON being willing & anxious to secure the aforesaid Joseph H KEELING the said sum of forty eight dollars & forty cents, and also in consideration of the sum of one dollar in hand paid by the said John GOODE, trustee for the said Joseph H KEELING, to the said Paschal J PENN & William W JOHNSON and before the ensealing and delivery of these presents, the receipt whereof is hereby acknowledged by the said Paschal J PENN and Wliliam W JOHNSON, he the said Paschal J PENN hath granted bargained and sold and by these presents doth grant bargain and sell unto the said John GOODE all his right, title and interest in two tracts of land lying on Buckhorn Road & which tracts were purchased for his mother for her life & since her death now belonging to the children of his mother, & all his the said Paschal J PENN right, title and interest in the estate of ELIZABETH PENN Brunswick County, and he the said William W JOHNSON hath granted bargained and sold & by these presents doth grant bargain & sell unto the sd (sic) John GOODE all his right, title and interest in the aforesaid two tracts of land on Buckhorn Road, which right, title & interest he acquired through his wife who was MARTHA A PENN, and which two tracts were purchased for TABITHA PENN for and during her life & at her death belonging to her children. To have and to hold the aforesaid right, title and interest in the aforesaid tracts of land which Tabitha PENN had the use and occupancy of have the said Paschal J PENN doth & of him the said Wm W JOHNSON unto him the said John GOODE, his heirs & etc, upon the following tracts and contiguous waters, to say, that if the said Paschal J PENN and William W JOHNSON shall each pay whatever is due to the sd Joseph H KEELING, to wit, if the said Paschal J PENN shall pay unto the said Joseph H KEELING the aforesaid sum of seventy five dollars & 95 cents and if the said Wm W JOHNSON shall pay unto the said Jos H KEELING the aforesaid sum of forty eight dollars & forty cents, & all costs in conveying this deed into effect, then this deed shall be void. Otherwise the said John GOODE shall proceed to sell to the highest bidder for cash all the rights, title and interest of both of them, the said Paschal J PENN and William W JOHNSON, the aforesaid two tracts of land at Mecklenburg courthouse, giving first ten days notice of the time and place of sale of said property and the proceeds arising from the sale to pay first all costs and charges in carrying this deed into effect, in the next place to pay the said Joseph H KEELING, his heirs etc the aforesaid debts due him. Lastly, if any balance, pay to the said Paschal J PENN and William W JOHNSON and said Paschal J PENN and Wm W JOHNSON each for himself doth covenant and agree to and with the said John GOODE that they the said Paschal J PENN and William W JOHNSON will warrant & forever defend the title of the aforesaid property unto him the said John GOODE. In testimony whereof, the parties have hereunto set their hands & affixed their seals the day and year above written. Signed and sealed by Paschal J Penn, William W Johnson and Jno Goode. Mecklenburg County court clerk's office 12th August 1844: The foregoing deed of trust was this day acknowledged in the clerk's office aforesaid by William W Johnson and Jno Goode, parties thereto to be their act and deeds and admitted to record as to them and at a court held for said cty (sic) on 19th August 1844. The same was acknowledged by Paschal J Penn & admitted to record. Acknowledged and delivered to J Goode.
