Persons or organizations desiring to use this material, must obtain the written consent of the contributor, or the legal representative of the submitter, and contact the listed USGenWeb archivist with proof of this consent. ****************************************************************** In the name of God Amen I Andrew Gregory of the County of Mecklenburg and the State of Virginia Considering the Frailty and uncertainty of life do make this my last Will and Testament in manner and form following to Wit First it is my will and desire that all my just debts and Funeral charges shall be paid, after which I lend unto my Beloved wife Frances Gregory during her natural life, the Tract of land whereon I now live including that part of the land purchased of Daniel Coleman adjoining the old tract on the north side of the road leading from Prudence Jeffries's to Thomas Norments, - Four choice Negroes, Four Choice Beds and Furniture and such of the rest of the Household and kitchen Furniture as she may wish to keep, Two choice horses one Cart, one Yoke of oxen and third part of the rest of the stock of every kind except Horses, and one third part of the crop of Tobacco Grain etc - I give unto the children of my Deceased Daughter Susanna Elam namely Andrew Daniel, Frances, Pheby, Nancy and John Elam Ninety Pounds Cash to be equally divided between them, I give unto my Deceased Son James Gregorys Children namely Patsey, Frances, Latney M. Andrew, Salley, Polley Y. and Nancey W. Gregory one Hundred pounds cash to be equally divided between them. I give unto my Deceased Daughter Frances Callis's Children namely Daniel, Henry, Elijah, James Elizabeth, and William Callis one Hundred Pounds Cash to be equally divided between them. I give unto my Daughter Sallie Couch one hundred pounds Cash. I give unto my Daughter Elizabeth Stembridge one Hundred pounds Cash, I give unto my Daughter Pheby Gregory one Negro Girl named Elina and one hundred pounds Cash, I give unto my son Elijah Gregory Two hundred and Fifty Acres of Land including the plantation on which he now lives in the Northwest corner of the Tract of Land purchased of James Webb, I give unto my son Thomas S. Gregory Two hundred and Fifty Acres of Land adjoining the above Tract given to my son Elijah Gregory on the East to extend to Cooks Road. The Above two Tracts of land containing five hundred Acres Given to my two sons Elijah and Thomas to be laid of by a line running paralel with North line extending from the west end of the land to Cooks Road. I give unto my Son John S. Gregory the Residue of the Tracts of land purchased of James Webb containing by estimation Eight hundred and Fifty four Acres, I give unto my Son Robert S. Gregory Sixty pounds Cash and the Tract of land Purchased of Thomas Coley containing by Estimation Two Hundred Acres adjoining the land of Ludwell Evans-Richard Russell and Others on the Waters of Kittle Creek, I give unto my son Silas M. Gregory the residue of the land purchased of Daniel Coleman including all the houses plantation etc lying on the South Side of the Road leading from Prudence Jeffries's to Thomas Norments and after the death of my Wife I likewise give unto my Silas M. Gregory all the land lent to her during her natural life before named in this Will, Which lands bequeathed to my five sons namely Elijah. John. Robert. Thomas and Silas I give unto them and each of them and their heirs forever. It is my will and desire that all the rest of my Estate not disposed of in this Will may be equally divided between Salley Couch, Pheby Gregory, Elijah Gregory, John S. Gregory, Robert S. Gregory, Thomas S. Gregory, Silas M. Gregory and the children of my deceased Daughter Frances Callis namely, Daniel, Henry, Elijah, James, Elizabeth, and William (I wish it to be understood that the Children of my Deceased Daughter last named shall receive only the Eighth part of this legacy to be divided between them) Which I give to them and each of them and their heirs forever - It is my Will and desire that after the death of my Wife all the property lent to her in this Will except the land may be equally divided between my Five sons namely Elijah, John, Robert, Thomas and Silas, Which I give to them and each of them and their heirs forever, It is my Will and desire that the Cash Legacys bequeathed in this Will to my Children and Grand Children shall be paid as soon as the money can be collected from such Bonds as may be on hand at my death and from the sale of such property as my Executors hereafter named may dispose of for that purpose--Lastly I hereby appoint my Trusted Friend Daniel Smith and my two sons Robert S. Gregory, and John S. Gregory Executors of this my last Will and Testament---- but my two sons Robert and John shall not be compeled to give Security for their Executorship In Witness whereof I have hereunto set my hand and seal this Twenty seventh day of October one Thousand Eight Hundred and Seventeen-- Signed Sealed [Signed] Andrew Gregory Seal and ratify'd In presence of William Richards Ludwell Evans John W. Harwood At a Court held for Mecklenburg County the 15th day of July 1822 The within written last Will & testament of Andrew Gregory was Exhibited in Court and proved by the oaths of two of the Witnesses thereto Subscribed, and ordered to be recorded. And on motion of Robert S. Gregory One of the Executors therein named, who made oath thereto according to Law, and together with his securities entered unto & Acknowledged bond in the penalty thirty thousand dollars, conditioned as the law directs, certificate is granted him for obtaining a probat of said Will in due - reserving Liberty to John S.
