Morris http://www.rootsweb.com/~archreg/vols/00003.html#0000743 ==================================================================== MONTGOMERY COUNTY, VA - Biographical Sketches - Jacob Cupp, b. abt: 1770 d. abt: 1853 ----++|++---- A Biographical Narrative of Jacob Cupp Montgomery County, Virginia Wife: 1st: Elizabeth Linn d/o Jacob Lyn/Linn & Phena -?- 2nd: Eve Kilmer d/o George Kilmer & Eve -?- Parents: Marcus Cupp/Kopp & Margaretha/Margaret -?- Jacob Cupp, son of Marcus and Margaretha (-?-) Cupp, born in Virginia abt. 1770 and lived in Augusta County and perhaps in neighboring Rockingham County until about 1810 or 11. Jacob is not mentioned in Marcus Cupp's Will, but is listed as one of the heirs in the executor's account. Jacob married his first wife, Elizabeth Linn, in Rockbridge County, Va. on 19 Aug 1802. Elizabeth's family had previously lived in Rockingham and this is where Jacob & Elizabeth probably first met. Jacob purchased 100 acres of Augusta County land on 26 Sep 1808 from Jacob & Polly Rapp. Whether Jacob and Elizabeth lived in Rockbridge, Rockingham or Augusta prior to this land purchase is not known. Elizabeth died about 1809/10 perhaps due to complications during the birth of her second son, David. Jacob is listed in the 1810 Augusta County census, age 26 to 44, with two sons under 10 years and having one slave. (This slave may have been a wet-nurse for the baby.) Elizabeth's two sons are mentioned in the will of her father, Jacob Lyn/Linn, proved at Rockbridge County in Jan 1818: --- Henry & David Cups, sons of my daughter Betsey Cups, deceased --. Jacob quickly remarried, probably because of his young son Henry and baby David. He traveled to Botetourt County where he wed his second wife, Eve Kilmer (b. abt: 1789) on 1 Nov 1810. Like Jacob's first wife, Eve's parents may have also lived in Rockingham County prior to Botetourt. (A George Kilmer received a 100 acres Rockingham land grant in 1794. The possibility that this is the same George Kilmer, as George Kilmer of Botetourt has not been explored.) Jacob and Eve sold his 100 acres to George Keller on 24 Jun 1811, about eight months after their marriage. They may have remained in Botetourt County after the wedding or more likely returned to Augusta to live until the land sale. Either way, they were living in Botetourt when their first child, Elizabeth, was born in 1811. Jacob and his family continued to live in Botetourt for an unknown time period; he was there when his son James was born abt. 1813. Jacob was a farmer, but not a land owner he rented plantations for family use. One land owner, William Wilson, initiated a Chancery suit against Jacob on 5 Oct 1814 saying: "Jacob Cupps hath agreed to pay him for the rent of a plantation the said Jacob Cupps now occupies the sum of fifty dollars on the 15 day of March 1815 of which he has received no part and that the despondent hath sufficient grounds to suspect and verily believes that the said Cupps hath removed part of his effects and absconded with himself before the said rent has become due." Wilson sought and was granted an attachment on part of Jacob's estate to cover the $50.00 rent. The County Sheriff seized one stack of wheat, one stack of rye, one stack of oats, one loom, one bar shear blough (plow?) and one bedstead on 7 Oct 1815 and sold them at auction for $25.00. On 8 Jan 1817, Wilson sued out a writ of fieri facias. (A legal paper authorizing execution on the goods of a debtor.) The writ was not returned probably meaning that Jacob was no longer in Botetourt County. This case would eventually follow Jacob to Montgomery County, Va. where it was finally settled in October 1842. Jacob and Eve are not listed in the Botetourt 1820 census nor are they in the census of Montgomery County where they would be residing in 1830. There is a Jacob Cupp in the 1820 census of Rockingham County. This Cupp family may have been Jacob and Eve, but this author has not pursued this possibility other than to compare their known children in 1820 to the Rockingham family. By 1820 Jacob had seven children, two by Elizabeth & five by Eve. Taking their approximate ages from later census and marriage records gives an approximate age breakdown for the 1820 census and for a comparison with the Rockingham Jacob's family. No female Eve's age was listed in the Rockingham census. Eve is known to have been living when her father, George Kilmer, wrote his Will 19 Oct 1819 at Botetourt County. A comparison of the known family of Jacob and the 1820 Rockingham Jacob's family makes it questionable that the two are the same family unless Eve was dead and some of the children were living outside the family. No marriage of Jacob has been found other than to Elizabeth Linn and Eve Kilmer. Jacob is said to have married Eve Huddle in Rockingham County in 1813 after the death of his second wife Eve. This cannot be true because Eve (Kilmer) was living in and after 1813. 1820 Census Comparison Males < 10 10 > 15 over 45 Females < 10 over 45 Jacob & Eve: 3 2 1 2 1 Rockingham Jacob: 1 1 1 2 0 If Jacob had left Botetourt by 1817 it is likely that he had moved to adjacent Montgomery County. In 1840 the executor of William Wilson (d. 1823) sued Jacob in Montgomery to recover the remainder of the $50.00 (plus court costs) from the Botetourt plantation rent judgment made in 1814. The executor in his complaint wrote: "--- Yet the said Jacob Cupps, though often requested, hath not paid the aforesaid sum of $55.28 nor any part thereof either to the said Wm Wilson in his lifetime or to the said Pltff. his executor since ----." Jacob does not seem to have been far removed from Botetourt during the period covered by these two court cases. (Rockingham records have not been examined for evidence that Jacob's family lived there around 1820.) Jacob and Eve were living in Montgomery County for the 1830 census. Their family, at the time of the census, consisted of eight children, including the two oldest by his first wife Elizabeth. The two youngest children were born after the 1830 census. (The 1850 census indicates William & Susan were born abt. 1830 and could have been twins. The 1860 census gives abt. 1830 for William's birth date and abt. 1832 for Susan's. The 1900 census shows that Susan Mary was born in Nov. 1832. William and Susan were probably not twins as the 1850 census indicated.) Two of Jacob and Eve's sons are not included in the 1830 census. Nov. 1832 On 26 Sep 1831 Jacob purchased from George & Jane Surface, 29-1/2 acres of Montgomery County land located on the east side of the Allegany Mountains. Later described as being on the North Fork of the Roanoke River near Blacksburg. This land is the only tract that Jacob is know to have owned other than the 100 acres of Augusta County land he sold in 1811. Jacob was exempted from County tax levies in 1835. The following are probably the family members living in Jacob's household in the 1840 Montgomery County census record: wife Eve, son William, daughters Nancy and Susan Mary. Eve (Kilmer) Cupp died in Montgomery County, Virginia sometime prior to the 1850 census. The family is listed in that census as follows: Jacob Cupp, age 80, William J. Cupp & Susan Mary Cupp, age 20. Living with the family is Isaac McMahan, age 22, who would marry Susan Mary in September 1850. Jacob Cupp died intestate at Montgomery County, Virginia about 1853/54. His son James Cupp was the estate administrator of record on 6 Jun 1854. Final settlement of the estate was not achieved until James initiated an 1863 Chancery suit in Montgomery County to divide Jacob's 29-1/2 acres of land among his heirs. Many of the details about Jacob's children are drawn from this suit that continued until about 1869 before ending. Jacob's 29-1/2 acres was purchased for $147.50 at the court ordered sale by his grandson, Anderson Cupp, son of James & Martha (Rinehart) Cupp. The money from this sale was to be divided among Jacob's surviving children or their heirs. - Jacob Cupp's Children - (1.) Henry Cupp, b. in Augusta County 28 Jul 1806, d. after 23 Aug 1872. Henry was living in Ohio at the time the Chancery suit to divide Jacob's land was initiated. From the original complaint bill: "Henry Cups resides in the state of Ohio and as an alien enemy his interest would belong to his brothers & sisters." Henry married 1st, Frances "Fanny" Switzer, 13 Feb 1834 at Augusta County. Henry and Fanny sold Augusta County land in 1847, 1852 & 1855 and traveled to Ohio sometime after the last land sale. Henry and his family were in Ross County, Ohio for the 1860 census. Henry had returned to Augusta County sometime prior to 13 May 1867 when he (a widower) married Mary Jane Cupp, widow of his brother William J. Cupp. Henry purchased Augusta County land on 5 Sep 1867 and sold land to Mary J. Cupp on 23 Aug 1872. This may indicate they were divorced abt. 1872. (Note: All of these land transactions are from Deed Book Index entries. Deeds and other court records need to be examined for the truth of the matter.) Henry, Mary Jane and her family are in the Augusta 1870 census. Mary Jane Cupp and her son Daniel were living in 1880 at Lee, Madison County, Iowa with her daughter Susan E. who had married Jeremiah Harless (See WorldConnect for this family.) Henry and his 2nd wife, Mary Jane Shirey)(Cupp)Cupp had no known children. Some if not all of his children by Frances Switzer remained in Ohio. James acquired several of his sibling's shares and transferred them, along with his own, to son Anderson. Samuel died in Augusta County prior to the suit to divide Jacob's land. He was probably the Samuel Cupp living in his Uncle & Aunt Daniel & Susannah (Cupp) Whitmore's household in the 1850 census. Samuel was unmarried and left no heirs. His one- tenth share of the purchase money from Jacob's land sale was to be divided among his siblings. Mary Jane married 2nd William's oldest brother Henry Cupp. Mary Jane was probably the Mary Shirey (servant or domestic help?) who lived 1850 in the household of William's Uncle Daniel Whitmore. (See 5. Samuel Cupp above.) William sold his share of his father Jacob's land on 14 Mar 1859 to Anderson Cupp, s/o James, for a saddle and twenty-five dollars. The John W. & Louvina (Heck) Cupp family first settled in Hawkins County about the year 1837. They arrived at or about the same time as the family of Jacob & Barbara (Kilmer) Heck. John and Louvina were first cousins, both the grandchildren of George & Eve -?- Kilmer of Botetourt County, Virginia. John & Louvina's first son, William, was born in Virginia about 1836/37 and their second son, Jacob, in Tennessee about 1839/40. Both the Heck and Cupp families had moved to Hawkins from the area of Botetourt/Montgomery County, Virginia. The 1840 Hawkins County census shows that nearby to Jacob Heck was the John Cupp family. Both John & wife were age 20 to 29 with two small sons less than five years old. John Cupp died in 1846 and his widow, Louvina, was listed as head of the household in the 1850 Census. Hawkins County, Tennessee 1850 Census: District No. 14 1/1 Lavania Jane Cupp, 33, b. Va. William Cupp, 13, b. Va. Jacob Cupp, 10, b. Tenn. Thomas Cupp, 8, b. Tenn. (census shows 18, but should be 8.) James Cupp, 5. b. Tenn. John Cupp, 4, B. Tenn. John W. Cupp was born about 1819 [1] in either Botetourt or Montgomery County, Virginia; the son of Jacob Cupp and Eve Kilmer. He died [2] in 1846 at Hawkins County,Tennessee. John W. Cupp has been traced back to his parents by way of an 1864 Court Case [3]at Montgomery County, Virginia. This Case was initiated by Cupp heirs for the settlement of the Jacob Cupp estate. Jacob Cupp had died in Montgomery County about the year 1853/54, his son James was administrator of record in 1854. During the settlement of Jacob's estate it was determined that one son, John Cupp, had removed from Virginia and had died in Tennessee [4][5] sometime prior to 1864. He was said to have left heirs, but the names of his wife & children were unknown to his siblings. Louvina Jane Heck, the daughter of Jacob & Barbara (Kilmer)(Harshbarger) Heck, born in 1818 [6] probably at Botetourt County, Virginia. She died at Hawkins County, Tennessee sometime after the 1880 census. Louvina Heck's name was spelled various ways in the records. 1850 Census: Luvana, 1860 Census: Lavenia, 1870 Census: Lavina & 1880 Census Lovana. Louvina's mother, Barbara Kilmer, first married in 1813 at Botetourt County, Henry Harshbarger. After Henry's death, Barbara married in 1816 at Botetourt her second husband, Jacob Heck. Barbara Kilmer was the sister of John W. Cupp's mother Eve Kilmer. Although the exact time and location of John & Louvina's marriage has not been found, the fact that Louvina's maiden name was Heck is confirmed by the death record for their fourth son, James Orville Cupp. (Death certificate #176: Greene County, Tenn., J. O. Cupp (James Orville), died 1918, age 74, b. Hawkins County, Tenn., Father: John W. Cupp, b. Va., Mother: Lavana Heck, b. Va.) Louvina was listed in the 1860 Hawkins County census as Louvina Mooney in the household of E. W. (Whitfield) Mooney along with several Mooney children. No marriage record has been found for E. W. & Louvina, but it is not unusual for a Hawkins County couples' marriage record to be missing from the official records. It is also not known what happened to E. W. Mooney after 1865, the records need to be searched in the attempt to clarify the relationship. E. W. Mooney (age 34)and his stepson, James O. Cupp (age 22), enlisted in C Co. 63rd Tennessee Infantry on 12 May 1862. They were both detailed as artilleryman of the post on 10 Apr 1862 by order of Lt Col Fulkerson. Whitfield and James appear to have served in the same Co. until James was captured in June 1864. E. W. Mooney was on the list of Confederate soldiers paroled at Appomattox Court House, Va. 9 Apr 1865. Death certificates for two of Louvina's Mooney children indicate their parents were Whitfield Mooney and Lavaner/Levanna Heck. In 1870 Louvina is again in the census as Louvina Cupp and is shown as head of her household with Cupp children, several who clearly should have been listed as Mooney. In 1880 she is Louvina Cupp, head of household with two Mooney daughters. Whitfield's age 34 at enlistment in the 63th Inf. shows that he would have been born in 1827/28. This closely matches the 1850 census age of Whitfield Mooney, (age 20, b. 1829/30) son of 14th Dist. Thomas & Sarah Mooney. Whitfield has not yet been found in the 1870 census. Louvina had changed her last name from Mooney to Cupp by 1870, this may indicate that she and Whitfield were divorced or separated after the Civil War. A Whitfield Mooney, age 50, (b. 1829/30) and wife Adaline, (age 40, (b. 1839/40) are listed in the 1880 census in the 8 Dist. of Greene Co., Tennessee. It is not yet known if this is the same Whitfield as the husband of Louvina (Heck)(Cupp)Mooney. Whitfield and Adaline seem to have been married about 1871 (oldest child: Mary J., age 8, (b. 1871/72 in Va.), either Whitfield had been married before or he was a bachelor until he was about 40 years old. Further research on Louvina's Mooney family after 1850 & prior to 1880 may clear some of the unknown. John may have served in Co. A 3rd Tennessee Cavalry, USA. Enlisted 15 Oct 1862, discharged 10 Jun 1865. (Pension application by Clarissa Cupp indicates Co. C, 3rd Tennessee Infantry.) Speculation: John F. Cupp's 1st wife may have been Mary (Hamilton) Cupp, the widow of his brother Jacob. The age, 22, of daughter Nancy J. Cupp living, 1880, in John's household matches the age (2) of Jacob & Mary Cupp's Nancy in 1860. Nancy J. Cupp would have been born about 1858. No actual record has been found indicating the person or persons in Hawkins County who received John W. Cupp's $9.94 share of the division. If they actually received their share is unknown. John was not mentioned in the deed made to Anderson Cupp (s/o James) who purchased the 29-1/2 acres of land.
