Murdock/Brown Deed, 1841 Montgomery Co VA Deed Book N:77-79. This indenture made the fourth day of December in the year of our Lord 1841 between ELIJAN MURDOCK & POLLY his wife of the one part and JOHN BROWN of the other part. Witnesseth: That the said Elijah Murdock for and in consideration of the sum of One Thousand Dollars lawful money of the commonwealth to be paid by the said John Brown at or before the insealing and delivery of these presents doth grant and sell unto the said John Brown, his heirs and assigns, four tracts or parcels of land lying and being in the County of Montgomery, one of which contains THIRTY-SEVEN ACRES more or less and bounded as followeth: Beginning at a black oak N58 W50 poles a stump in a field, thence S74 W48 poles to a sycamore, thence N54 W72 poles to two white oakes corner a hickory & mayple on Peter Hornbarger's line & with it N80 E134 poles to a double white oak, corner to Taylor's land & with a line S15 E52 poles to the beginning. This is the same tract of land which was patented to Daniel Hornbarger on the 5th November 1802 and was conveyed to said Murdock by said D Hornbarger and there lying and being interferance with Davidson Charlton's land, the lines of the patent have been somewhat changed. One other tract of SEVEN ACRES patented to said Daniel Hornbarger the 2nd May1829 and was conveyed by said Daniel Hornbarger to the said Murdock by deed. One other tract of TWENTY-FIVE ACRES deeded to the said Elijah Murdock by Peter Hornbarger and wife by deed bearing date this 3rd day of June 1839, and also one other tract or parcel of land containing FOUR ACRES and twelve poles, being the land conveyed by the said Peter Hornbarger to the said Elijah Murdock by deed dated the __ day of December 1839, all of which deeds are of record in the clerk's office of Montgomery County and to which reference is hereby made, for the causes and distances. It is hereby mentioned that the four acres and twelve poles is to come off of the tract which is the extent of the interference of Davidson Charlton's land and Peter Hornbarger's land ofthe last part mentioned in this deed of four acres and twelve poles was conveyed to the said Murdock in lieu thereof with all and singular the advantages and appurtenances whatsoever to the said four several tracts of __ lands belonging or appertaining to the only proper uses of him, the said John Brown, his heirs or assigns forever. To have and to hold the said four tracts of parcels of land with the tenements thereon all and singular, the premises herein before mentioned or intended to be bargained and sold and every tract and parcel thereof with every of their rights, premises and appurtenances unto the said John Brown, his heirs and assigns forever. And the said Elijah Murdock and Polly his wife for themselves and their heirs the said lands with all and singular the premises and appurtenances as before mentioned, unto the said John Brown, his heirs and assigns, fee from the claim or claims of them, the said Elijah Murdock & Polly his wife, their heirs, & of all and every person or persons whatsoever shall, will and do warrant forever, defend by their presents. In witness whereof, the said Elijah Murdock and Polly his wife have hereunto set their hands & seal on the day and the year first above written. Elijah Murdock (seal) her Polly x Murdock seal Montgomery County Sc Wi: Robert Gardner & H McG Kent, Justices of the Peace in county aforesaid in the state of Virginia do hereby certify that Polly Murdock, the wife of Elijah Murdock, parties to a certain deed bearing date the 4th day of December 1841 and hereunto annexed, personally appeared before us in our county aforesaid, and being examined by us and from her husband, and having the deed afterward fully explained to her, she the said Polly Murdock acknowledged the same to be her act and deed, and declared that she had willingly signed, sealed and delivered the same & that she wished not to retract it.
