MONTGOMERY COUNTY, VA - Land Records - John Wade, Commissioner to Anderson Cupp, 2 November 1868 ----¤¤¤---- John Wade, Commissioner to Anderson Cupp Montgomery County, Virginia Deed Book S, Page 110 - 111 Acknowledged: 1 May 1869 This Deed made the 2nd day of November 1868. By and Between Jno J. Wade Commissioner on the part of the County Court of Montgomery County in the Chancery Cause of James Cupp against Cupp & al therein depending of the one part and Anderson Cupp of the other part, Witnesseth that whereas L F J Amiss as Commissioner on the part of said Court & in pursuance with a decree entered at the October Term of said Court 1865 in said Cause did sell to Anderson Cupp all the right title & interest of Children & heirs of Jacob Cupp Dec'd in & to a certain tract of land Containing 29 1/2 Acres for the sum of $147.50. The said tract of land situated on the waters of the North fork of Roanoke in said County of Montgomery & adjoining the lands of Francis Henderson, Giles Thomas & Edwin J. Amiss & being the same land which was formerly owned by said Jacob Cupp & at his death descended to Henry Cupp, John Cupp, Elizabeth Hoover wife of Jacob Hoover, Ann McMahan wife of Washington McMahan, Susan McMahan wife of Isaac McMahan, Nancy Carter wife of Wm Carter, James Cup, William Cupp & Samuel Cupp Children & heirs of said Jacob Cupp dec'd and parties to said suit. And whereas under another decree entered in said Cause at the November Term 1868 of said Court the said John J. Wade was appointed a Commissioner on the part of said Court to collect the balance of the purchase money remaining unpaid from said Anderson Cupp & upon the payment of the sum the said Commissioner Wade was Authorized & required by said decree to convey to said Anderson Cupp all the right title & interest of the said Children & heirs of said Jacob Cupp in & to the said tract of land. And whereas the said Anderson Cupp has this day paid to said Wade as Commissioner the said balance of purchase money aforesaid, Now this deed Witnesseth that the party of the first part in consideration of the premises & for the purpose of carrying into effect the said Decree of said Court doth hereby grant and Convey unto Anderson Cupp all the right title & interest of the above named parties Children & heirs of Jacob Cupp in & to the said tract of 29 1/2 acres above described with special warranty. This deed from Jno J Wade Commdr to Anderson Cupp was delivered to me and acknowledged by said Wade Commr as his act & deed and fifty cents US Revenue Stamp being thereon was admitted to Record. John C Wade DC *********************************************************************** Jacob Cupp's wife was Eve Kilmer. Jacob Cupp & Eve's marriage bond is dated 30 Oct 1810 at Botetourt County. Surety was George Kilmer, father of Eve. (See Botetourt County Archives for the Will of George Kilmer.) Jacob was a resident of Augusta County at the time of their marriage and they may have returned to Augusta to live until they sold Jacob's land in June 1811. Jacob and Eve could have remained in Botetourt and returned to Augusta only for the land sale. They lived in Botetourt for a time then removed to Montgomery County. Eve was living when her father's will was written 21 October 1819. She died in Montgomery County prior to the 1850 census. Jacob may have been married to another, name unknown, in Augusta County prior to Eve Kilmer.) Margaret Ann Cupp b. ca 1817, d. 15 Aug 1901, m.
