VA C-9.122 Deed Jonathan Currin & Elizabeth Currin to John Wygal Jr., 1833 [Submitter note: This property is part of the 1070 acre land patent to Robert Currin in 1797. Jonathan Currin, his son sold 570 acres, his portion of the land to John Wygal, Jr. It is noted that Jonathan and Robert P. Currin were the sole surviving children of Robert Currin and Ann Thomasson at this time. This indenture made the 14th day of August one thousand eight hundred and thirty three between Jonathan Currin and Elizabeth Currin of the county of Rutherford State of Tennessee of the one part and John Wygal Jun. of the county of Montgomery and William Lancaster of the Town of Lynchburg of the other part, Witnesseth that the said Jonathan Currin and Elizabeth his wife for and in consideration of the sum of fourteen hundred dollars to them in hand paid the receipt which is acknowledged do give grant, bargain, sell, above confirm unto the John Wygal and William Lancaster and their heirs a certain piece or parcel of land containing five hundred and seventy acres be the same more or less part of a patent of 1040 acres granted to Robert Currin the 30th day of March 1797 and by the said Robert Currin, deceased, by will to his son the said Jonathan Currin situate in the said county of Montgomery on the waters of New River and bounded as follows. Beginning at a poplar and white oak near a sharp hollow on the patent line and on the north east side of _______. Thence with the same and that also of Thomas Cloyds North 24 west one hundred and five poles to two white oaks and a white oak sapling on a flat ridge. South 84 West 87 poles to two white oaks North 72 West 244 poles to a forked white oak and white oak by a path, thence leaving said Cloyds line South 49 west 80 poles to four white oaks South 17 West 47 poles to a white oak and two white oak saplings, South 84 East 28 poles to two black oaks and a white oak South 40 West 144 poles to a white oak and double black oak South 35 East 140 poles to three white oaks on the patent line, and on the south west side of the patent tract thence along the patent line and across the tract North 79 East 264 poles to three white oaks on the north side of a hill, North 45 182 poles to three white oaks North __ East 82 poles to a red oak black oak and mulberry. South 37 East 38 poles to a ____ white oak and walnut in a hollow North 71 East 22 poles to the beginning, together with appertunances to the said John Wygal and William Lancaster their heirs and assigns to the sole use and behalf of the said John Wygal and William Lancaster their heirs and assigns, and the said Jonathan Currin and Elizabeth Currin his wife for themselves and their heirs the said piece or parcel of land and all [bottom line of page not printed]. Jameson and William Gilliam Magistrates in the same county do hereby certify that Jonathan Currin party to the within conveyance hath duly acknowledged the same before us on the 14th day of August 1833 and desired us to certify the same to the clerk of the county court of Montgomery, Virginia in order that the same may be recorded. Jameson & William Gilliam Justices of the peace in the county aforesaid in the State of Tennessee do hereby certify that Elizabeth Currin the wife of Jonathan Currin parties to a certain deed for the conveyance of real estate to John Wygal and William Lancaster bearing date of the 14th day of August 1833 and hereto annexed, personally appared before us in our county aforesaid and being examined by us privily and apart from her husband and having the deed aforesaid fully explained to her, she the said Elizabeth Currin acknowledged the same to be her act and deed and desired that she had willingly signed sealed and delivered the same and that she wished not to retract it.
