Currin/Wygal Deed, 1835 - Montgomery Co. VA C-9.129 Deed Robert P. Currin and Margery M. Currin to John Wygal Sr., 1835 Montgomery County, Virginia Deed Book, page no.??. 5 February 1835. This indenture made this fifth day of February in the year of our Lord one thousand eight hundred and thirty five between Robert P. Currin and Margery M. Currin his wife of the County of Williamson & State of Tennessee of the one part and John Wygal Sr. of the County of Montgomery in the State of Virginia of the other part Witnesseth that the said Robert P. and Margery M. Currin for and in consideration of the sum of fifteen hundred dollars the receipt whereof is hereby duly acknowledged have given or granted bargained and sold and by these presents do give grant bargain sell and convey unto the said John Wygal Sr. his heirs and assigns two certain tracts or parcel of land (Except the grave yard) as herein after more particularily excepted & lying in the said County of Montgomery one containing four hundred and ninety acres more or less on the north side of New River being part of a tract of one thousand and sixty acres patented to Robert Currin the thirteenth day of March seventeen hundred and ninety seven and by the said Robert Currin, deceased, to his son the said Robert P. and bounded as follows (as appears by the report of commission appended to set ______ and _____. To Wit: Bounded _____ buckeye ___ [writer's copy of this line is not readable.] being part of the said 1060 acres patent thence across the said patent tract _______ said 570 acres South 71 West 22 poles to a red oak white oak and walnut on a hollow North 37 West 38 poles to a red oak black oak and mulberry South 85 West 82 poles to three white oaks South 45 West to the three white oaks on the the north side of a hill 182 poles South 79 West 264 poles to three white oaks on the southwest end of the tract. Thence with the same leaving the said 570 acres South 35 East 20 poles to two white oaks South 70 East 98 poles to a black oak and red oak South 48 East 107 poles to mulberry on a hillside near the river. South 51 West 52 poles to two white hickorys on the river bank. Thence down the several courses & bending thereon 345 poles to the beginning. The other tract containing one and three quarter acres being an island in said New River nearly opposite the lower end of the said 490 acres the said one and three quarters acres were also patented to the said Robert Currin the 4th day of November 1797 and by the said Robert Currin, deceased, to his son the said Robert P. and bounded as follows to wit: Beginning at a cucumber tree on the north side of the island and running thence South 10 West 2 poles to a sycamore on the south side of the island thence up the same and binding thereon 98 poles to a pile of stone at high water mark. North 10 East 4 poles crossing the island to a pile of stones thence down the same and bending thereon on the north side then of 77 poles to the beginning. To have and hold the said two tracts of land with the appurtenances thereunto belonging to the said John Wygal his heirs and assigns forever and the said Robert P. and Margery M. for themselves their heirs and do covenant and agree to and with the said John Wygal his heirs and that they will forever covenant the title and possession of the said two tracts of land to the said John Wygal his heirs & against the lawful claim or entry of all and every person whatsoever. But it is expressly understood that the said Robert P. and Margery M. do reserve and they hereby reserve out of the tract of four hundred ninety acres Forty feet Square of ground to include the graves of the father and mother and other relatives of the said Robert P. Currin and they do not grant the same to the said John Wygal. In witness whereof the said Robert P. and Margery M. Currin party to the within conveyance hath duly acknowledged the same before us on the fifth day of February 1835 to be his act deed and desired us to certify the same to the clerk of the county court of Montgomery County in the State of Virginia in order that the same may be recorded.
