Patton/Gresham Lease, 1779 - Montgomery Co. VA This Indenture made the Twenty fifth day of March one thousand seven hundred and seventy nine between Wm. Thompson and William Preston only acting Executors of the last will and Testament of James Patton, late of the County of Augusta, Gent. deceased, of the one part, and Robert Gresham of Montgomery County of the other part. Witnesseth, That pursuant to the power and authority given in and by the last will and Testament of the said James Patton and for the sum of Thirty five Pounds, by the said Robert Gresham paid before the sealing and Delivery hereof to the said Wm. Thompson and Wm. Preston and by them applied to the uses mentioned in the said will they the said Wm. Thompson & William Preston have given granted bargained and sold, released and confirmed, and by these presents do give grant bargain sell release and confirm unto the said Robert Grisham (in his actual possession now being by virtue of bargain and sale dated hereof, and by Force of the Statute for Transferring Uses into Possession and to his heirs and assigns forever, all that Tract or parcel of land of which the said James Patton was seized containing one hundred and seventy five acres, be the same more or less, being part of a large Tract granted to the sd James Patton by letter Patent bearing date the XXth day of June MDCCLIII. Laying and being in the County of Montgomery formerly Augusta on the waters of Stroubles Creek a branch of New River and bounded as followeth; Beginning at a black oak saplin by a spring and running thence South sixty seven degrees West one hundred and Thirty poles to two hickory saplins Thence North Two hundred and Thirty Poles to a hickory and white oak saplins by a spring head. Thence South Thirty five degrees East one hundred Poles to two chesnuts Thence North Twenty degrees East one Hundred and sixty four Poles to a white oak in a valley Thence South seventeen degrees East eighty eight Poles to two black oaks Thence South sixty degrees West one hundred and forty Poles to the Beginning, with all ways, wood, water-courses, privileges, profile and advantages whatsoever to the same belonging or in any way appertaining, and the Reversions and remainders thereof, and all the Estate, Right, Title or Interest of them the said William Thompson and William Preston or of the said James Patton Deceased, in or to the same. To have and to hold the said lands and premisses hereby conveyed with the appurtenances unto the said Robert Gresham, his heirs and assigns forever to his own proper use and the said William Preston and Wm. Thompson and their heirs, the said lands and privileges hereby conveyed and every part thereof, unto the said Robert Gresham, his heirs and assigns against them the said Wm. Thompson and Wm. Preston and their heirs and against the sd James Patton and his heirs and all and every person or persons whatever, shall and will warrant and forever defend by these presents.
