MONTGOMERY CO. VA WILL BOOK 7 pg 115 MICHAEL EKISS In the name of God amen, I Michael Ekiss Sr. of Montgomery county and state of Virginia being in perfect health and sound mind and memory and knowing the uncertainty of life and that it is appointed unto all men once to die, do make institute and declare this to be my last will and Testament revoking all others by me made and declared. First I resign my soul to God who gave it and my body to the ground in full hopes of its resurrection at the last day to be buried in a decent and christian like manner at the discretion of my Executors and as to my worldly substance with which it has pleased God to bless me I bequeath it in the manner and form following. First I allow my funeral expenses and all my just debts to be paid. Item First I give unto my wife Catherine Ekiss my estate both personal and real should she survive me to have and to hold the same and dispose of thereof as she may think proper with the following exceptions. Viz I give my son Henry Ekiss one dollar to be paid to him out any money that may be in the hands of my executor after paying my just debts. I further give to my son Michael Ekiss Jr. One dollar to be paid to him in like manner. I do appoint my trusty friend and worthy neighbor William McDonald Executor of this my last will and testament and do require of him to execute and faithfully fulfill al requisitions of the above testament and further I require him to act as Guardian of my wife Catherine to attend the renting of her lands and collecting the rents of the same and that no frauds are practiced on her either my her children or strangers and my will is that she also consult him my said executor on all occasions in case of necessity. In testimony of this instrument being my last will and testament I hereto subscribe my name and offer my seal this fourth day of September in the year of the Lord 1830. Signed in presence of Sam K. Wilson James Bane B. Hall Jr. James McDonald presented June Court 1837. Wm. McDonald refused to be executor and John Barger was appointed by the court.
