Last Will & Testament of Henry Fizer, 1813 Will Book 2 Page 415 Montgomery Co. Circuit Court In the name of God the Father, God the, and God the Holy Ghost, amen, I, Henry Fizer of the County of Giles in Commonwealth of Virginia being in perfect health and sound mind and memory but calling to mind the mortality of my body and knowing that it is appointed for all men to die to make this my Last Will & Testament, first and principally, I recommend my soul to God who gave it and my body I resign to the earth to be buried in a decent and Christian like manner, at the discretion of my friend who may be present, not doubting, but at general resurrection I shall give(?) the same by the powers of all mighty God who gave it, and as touching such worldly estate with which it has pleased God to bless me in this life I dispose of in the following manner. I direct that all my just debts to be paid by my personal executor hereafter to be named but if out of such part of my personal estate as I shall direct I will and bequeath unto my beloved wife Margaret all of my personal estate together with my land at my death after my children have what I allow them I give and bequeath my eldest, Michael Fizer, $24.00 for serving in my place in the Revolutionary War; Adam Fizer, $1.00; Henry Fizer, $1.00; John Fizer, $1.00; Jacob Fizer, $1.00; Peter Fizer, $1.00; George Fizer, $1.00. I also give and bequeath unto my daughters as follows: Peggy Keffer, $1.00; Polly Jones, $1.00; Elizabeth Haymaker, $1.00; Catherine Overholser, $1.00 and the balance is my wife's own property until death and at her death my will is to have all the remainder of my property divided equally between all of my children; and this I acknowledge to be my Last Will and Testament and do hereby make and renounce all other wills and testaments by me formally made. In witness whereof I have hereunto set my hand and seal this 9th day of February, 1813. Signed and sealed in the presence of Phillip Lybrook, Ferdinand Harless, John Fisher. Signed by Henry Fizer with his mark. This was recorded at the Montgomery County Clerk's Office in the June, 1816, term of Court. Codicil to the Will of Henry Fizer in Will Book 3 Page 40 Whereas Henry Fizer of Montgomery did on the 9th day of February, 1813, while living on my plantation in the County of Giles make and sign my Last Will and Testament in which I made such bequests and distributions of my Estate as appeared to me to be proper and equitable, but having since that time removed to the house of my daughter, Elizabeth Haymaker, where I expect to live the balance of my days and in part of the consideration for the support of myself and wife the amount of the rents (?) my plantation aforesaid is to be paid to my daughter Elizabeth or son-in-law Phillip Haymaker, but believing that the amount will not be sufficient for the support of myself and wife, my will and desire is further that there shall be an account kept from the 13th day of April last (1815) to the time of the death of my wife or to such time as she may discontinue to live with my said daughter, Elizabeth Haymaker and after my own and my wife's death I wish the account as before mentioned submitted to three discreet, disinterested and honest men to determine how much over and above the rents aforesaid shall be paid for our support and maintenance during the time before mentioned and after such account is made up and signed by three such persons as before mentioned or any two of them, it is my will and desire and I do order my executor or administrator that such amount be paid out any monies arising from the sale of my estate as soon as can be collected to my daughter Elizabeth or my son-in-law Phillip Haymaker to them their heirs forever and I wish it understood that the allowance made to my daughter Elizabeth as before mentioned is to be exclusive of any part of my estate to which she may be entitled by my will before referred to, and it is my desire that this codicil be considered and taken in every respect as part of my Last Will and Testament.
