Will of George Surface, 1873 In the name of God, Amen. I, George Surface of the County of Montgomery & State of Virginia, being at this time of advance age & feeble & infirm, yet blessed with sound mind & memory & feeling the importance of disposing of what worldly estate it has pleased God to bless me with. I do hereby make my Last Will & Testament as follows. In the first place, I want all my property, both personal & real to be kept together and controlled by my wife Catherine Surface during her lifetime and I want her as soon as she can conveniently to buy my son Floyd D. Surface a buggy to be paid for by disposing of just such property as she may think best and as soon as she can after paying for the buggy I want her to pay to my son Wm. S. Surface two hundred dollars if she can raise that amount for him during her life, it is to be paid out of my estate over and above the others. Item-Second I give and bequeath to my four grandchildren, namely James T. Ollinger & Kitty Ollinger, the two children of our daughter Elizabeth, deceased, two hundred dollars each & Charles W. Surface & George D. Surface, the two children of our son Michael H. Surface, deceased two hundred dollars each. Item 3- I give to my grand child Charles W. Surface in addition to the two hundred dollars, a horse, saddle & bridle & to my granddaughter Kitty Ollinger in addition to her two hundred dollars a horse, bridle & saddle. Item fourth. I want my property after the death of my wife Catherine Surface to be equally divided between my four daughters, Eliza Jane Weaver, Rebecca Dobbins, Emma Kinsey & Lavinia Lucas & my three sons, John Surface, Wm. S. Surface & Floyd D. Surface, having before given to the heirs of my daughter Elizabeth, decd & my son Michael what I think was their just Proportion. Item the fifth. I want the instrument of writing I gave to my son in law Floyd Dobbins concerning the improvements made where he lives to remain in full force & virtue as if I had not made this will. Item Sixth. I do further state that if any of the heirs of my estate herein mentioned should go to law or institute and litigation in reference to the disposition of my property or the soundness of my mind they shall forfeit what I have willed to them in this my last will and testament. Lastly, I nominate & appoint my son John Surface to be my executor & to dispose of my property as above mentioned after the death of my wife Catherine.
