Kilby Nansemond Co., VA, Deed Book 33 (1893-1894), page 199 February 20, 1894 * * * * * * * * * * This deed made the 19th day of February A.D. 1894 between John Shepherd and Jane Rebecca Shepherd his wife of the Town of Suffolk in the County of Nansemond and State of Virginia of the one part and Wilbur J. Kilby of the same town, county and State chosen trustee for the purpose herein specified of the other part, Witnesseth: That the said John Shepherd and Jane Rebecca Shepherd his wife do grant with general warranty unto the said Wilbur J. Kilby, chosen trustee as aforesaid, the following real estate, to-wit: 1. All that certain lot or parcel of land situated on the east side of North Street in said Town, County and State, fronting on the said Street fifty (50) feet and running back eastward therefrom on the north side ninety-four (94) feet, on the south side one hundred (100) feet, and being forty-six (46) feet and eight (8) inches wide across the rear or east end, and bounded on the north by the land of George T. Holland, on the east by the land of Sarah C. Nurney, on the south by the land of Martha J. Johnson and on the west by the said Street and being the same lot or parcel of land which by deed dated the 20th day of January A.D. 1894 and recorded at the same time with this deed in the office of the Clerk of the County Court of said County, was sold and conveyed by Burwell Riddick and Ada B. Riddick, his wife unto said John Shepherd together will all and singular the appurtenances belonging to the same. 2. All that certain lot or parcel of land situated on the North-west corner of Chestnut and Market Streets in said town, County and State and bounded and described as follows: Beginning at the North-west corner of said Streets and running thence north along said Chestnut Street sixty-six (66) feet, thence west ninety (90) feet, to the land of John F. Pinner, thence south sixty-four (64) feet to said Market Street, and thence east along said Market Street to the beginning, and being the same lot or parcel of land which by deed dated this day and recorded in said office at the same time with this deed, was sold and conveyed by Merritt Briggs, Trustee, unto the said John Shepherd together with all and singular the appurtenances belonging to the same. In trust to secure to Dr. Richard E. Parker the payment of the sum of five hundred (500) dollars due and payable to him by the said John Shepherd as evidenced by the bond of said John Shepherd dated this 19th day of February A.D. 1894 and payable to the said Dr. Richard E. Parker one year after its date with interest on said sum of five hundred dollars from its date. And the said Wilbur J. Kilby trustee as aforesaid is hereby authorized and empowered to sell the said parcels of land by public auction for cash after reasonable advertisement of the time, place and terms of the sale in such manner as he may deem best and to make the purchaser a good and sufficient deed conveying said parcels of land to him, if default be made in the payment of said sum of five hundred dollars at the maturity of said bond, and out of the proceeds of the sale to pay first in full all the costs and expenses of the sale including a commission of five per cent on the gross proceeds of the sale to be retained by himself (said trustee) for his services and then to pay said sum of five hundred dollars and all interest due thereon, and then to pay the surplus, if any, as the law directs.
