Nansemond County, VA - Deeds - Merritt BRIGGS, trustee, to John SHEPHERD 20 Feb 1894 Deed of Bargain & Sale * * * * * * * * * Merritt BRIGGS, Trustee To John SHEPHERD Nansemond Co., VA, Deed Book 34 (1893-1895), page 117 February 20, 1894 * * * * * * * * This deed, made the 19th day of February, 1894, between Merritt Briggs, trustee, of Suffolk, Virginia of the first part, and John Shepherd of Suffolk Virginia of the second part. Whereas B. F. Doe and Mary J. S. Doe his wife by deed bearing date on the 5th day of June, 1889, and recorded in the Clerk's Office of Nansemond County Court in D.B. 22, page 108, did convey to the said Merritt Briggs, Trustee, in trust, to secure to Dr. R. E. Parker, the payment of a certain sum of money therein specified, the following Real Estate, to-wit: All that certain lot of land in the town of Suffolk, County of Nansemond and State of Virginia and bounded and described as follows: "Commencing at the north-west corner of what is known as Chestnut and Market Streets in said town, and thence running north along said Chestnut Street sixty-six (66) feet, thence westerly ninety (90) feet to the land of Jno. F. Pinner; thence south sixty-four (64) feet to Market Street; thence eastwardly eighty-six (86) feet, to the beginning; and being a part of what is known as the Harrison land. This lot or parcel of land was conveyed to the said B. F. Doe by deed dated the 29th of March, 1888 from Sarah C. Nurney in her own right, Jno. F. Nurney and Sarah C. Nurney his wife, Rena Eulley and H. (?) R. Eulley, Trustee." The said deed of trust was given to secure a debt due to the said R. E. Parker by Robinson Grant evidenced by a bond for the sum of ($300.00) three hundred dollars. By which deed of trust the said trustee Merritt Briggs was empowered on the failure of the said Robinson Grant to pay the sum of money therein mentioned, or any part thereof, when the same should become due and payable, to sell the above described property for the purposes of the said trust. And whereas default having been made in the payment of the said debt and the said sum of money the said trustee, in execution of the trust aforesaid, being thereto required by R. E. Parker, did on the 12th ay of February, 1894, after giving sixty days notice of the time, place and terms of sale, by printed hand bills expose to sale by public auction, to the highest bidder, the property above described. At which sale the said John Shepherd having made the highest bid therefore, became the purchaser of the said property at the price of Four hundred & sixty five dollars, and having complied with the terms of sale, has requested that the same be now conveyed to him, the said John Shepherd. This Deed therefore Witnesseth, that the said Merritt Briggs trustee in the performance of his duties as trustee and in consideration of the sum of Four hundred and sixty five ($465) Dollars, paid or secured to be paid doth grant, with Special Warranty, unto the said John Shepherd the said property hereinbefore referred to and described. Witness the following signature and seal. Merritt Briggs, Trustee (Seal) State of Virginia County of Nansemond, to-wit: I, R. H. Rawles, a Notary Public for the County aforesaid, in the State of Virginia, do certify that Merritt Briggs trustee, whose name is signed to the foregoing writing, bearing date the 19th day of February, 1894, has acknowledged the same before me in my County aforesaid.
