Kilby true and lawful Attorney, irrevocably, with power of substitution, for me and in my name, place and stead, to ask, and rec3eive of and from the United States any Bounty Land, Money or Moneys that now is or are due to me on account of services rendered, disbursements made, or expenses incurred by me while in the service of the United States, or on any other account whatsoever, and in my name to give receipts and other sufficient discharges for such Bounty Land, Pensions, Patents, and Money due as aforesaid, and to attend to and prosecute any and all business of whatever nature I may have with or before any of the Departments of the Government, or Congress, and generally, to do any and every other act or acts, that I might or could do, were I personally present at the doing thereof; hereby ratifying and confirming whatsoever my said Attorney shall do in and about the premises by virtue hereof. On the 11th day of October A.D. one thousand eight hundred & fifty, personally appeared before me a Justice of the Peace in & for said county & state, Bray Baines, aged fifty seven years, a resident of said County & State, who being duly sworn according to law, declares that he is the identical Bray Baines who was a Private in the Company commanded by Capt. Arthur Smith, in the 59th Regiment of Virginia Militia commanded by Col. Josiah Riddick, in the War with Great Britain declared by the United States on the 18th day of June 1812. That he was drafted at Suffolk on or about the last day of August 1813, for the term of three months & was honorably discharged at “The Poplars” in Norfolk County on or about the first day of October 1813 as will more fully appear by reference to the Rolls of said Company never having received any discharge certificate. That he was also drafted in the month of May 1813 or about that time under the same officers in same Regiment, served for about one month & was honorably discharged as the rolls of said Company will show, never having received any certificate of discharge. He makes this declaration for the purpose of obtaining the bounty Land to which he may be entitled under the “act granting bounty land to certain officers and soldiers who have been engaged in the military service of the United States” passed 28th of March 1850. his Bray X Baines mark Sworn to & subscribed before me on the day & year first written in the foregoing affidavit & declaration and I hereby certify that I believe the said Bray Baines to be the identical man who served as aforesaid and that he is of the age above stated. B. F. Gallaher For 3rd Auditor Commissioner of Pensions Dept of Interior Salomon. Suffolk Apr. 29, 1851 Sir By a note from the Dept, I am informed that Bray Baines is not on the Roll of Capt. Arthur Smith’s Co. in late war. I apprehend there is a mistake in the examination. He says he was. Now there two Arthur Smiths – one in the 59th Regt under Col Jos. Riddick with whom Mr. Baines served – the other was in 21st Regt, Col. Lucas. The one in 59th Regt. was commander of a Co. but was probably a Lieut. By reference to the Rolls again you will doubtedly find it correct. May I ask your attention to it. Respy John R. Kilby Atty for Bray Baines Com Pensions Pension Office May 21/51 Sir I have to inform you in reply to your letter of the 29th of April last, in relation to the application of Bray Baines, that the examination made by the 3d Auditor was made from the rolls of Captain Arthur Smith’s Company 59th Regiment Virginia Militia and as you state in your letter that Bray Baines was a Private of the Company of Arthur Smith of the 59th Regiment, no further examination is deemed necessary. The rolls being altogether silent as to the claimant the positive testimony of officers and soldiers with whom he served and whose names are on the rolls will be received as evidence. Kilby, a Notary Public in and for said County & State came Bray Baines, who being sworn declares that his claim for Bounty Land under the act of Congress of 28th September 1850 is now on file & is suspended for want of proof of service – that he again reiterates his service under Lt. Arthur Smith of 59th Regiment Va. Militia in War of 1812, and now furnishes evidence of his service which he prays will be allowed as satisfactory. Kilby, Notary Public State of Virginia Nansemond County {SS} On this the 13th day of June 1853 personally came before me John R. Kilby a Notary Public, in and for the said County & State, Wiley Brinkley and James Byrd residents of said County, who being duly sworn declare that they are well acquainted with Bray Baines, whose name is signed to the foregoing declaration. That the said Bray Baines was a private in the Company commanded by Lt. Arthur Smith in 59 Regt. Under Col Josiah Riddick in Va. Militia in the War of 1812. That the said Bray Baines was in actual service in the said war and in the Company & Regiment aforesaid for about two months, to the certain knowledge of the deponents, the precise number of days not recollected & that the said Baines was honorably discharged. The said Wiley Brinkley further states that although he was not in the same Company with Mr. Baines yet he was in the same Regiment under Capts. Laycock & Vesey & went from the same neighborhood with Mr. Baines & frequently saw him in service and is confident therefore as to his statement. The said Wiley Brinkley has received for his service in said war a warrant for eighty acres, No 9016 ----- and the said James Byrd, declares that he served in the same company with said Baines for several weeks & was then transferred to another Company under Capt. Washington Smith and knows that the said Baines served as aforesaid & that the said Byrd has received a Land Warrant for eighty acres, No 11.435 – and these deponents further declare that they are entirely disinterested witnesses. his Wiley X Brinkley mark his James X Byrd mark Subscribed & sworn to before me as above set forth. STATE OF VIRGINIA COUNTY OF NANSEMOND {SS.} On this 20th day of March A.D. one thousand eight hundred and fifty five, personally appeared before me a Justice of the Peace, within and for the County and State aforesaid, Bray Bains aged 61 years, a resident of Nansemond County in the State of Virginia who being duly sworn according to law, declares that he is the identical Bray Bains who was Private in the Company commanded by Captains Arthur Smith & Laycock in the _____ Regiment of Va Mil commanded by Col. Josiah Riddick in the war with Great Britain declared by the United States on the 18 day of June 1812 and continued in actual service in said war for about 4 months that he has heretofore made application for Bounty Land under the act of Sept. 28, 1850,and received a Land Warrant, No ______ for 40 acres. See proof filed in the Department of his service. He makes this declaration for the purpose of obtaining the additional Bounty Land to which he may be entitled under the “act approved March 3, 1855”. He also declares that he has never applied for nor received under this or any other act of Congress, any Bounty Land Warrant, except the one above mentioned. The he hereby authorizes William Sumner of Nansemond County, Va. to receive for him his Bounty Land Warrant as his attorney. his Bray X Bain {seal} mark We, James J.
