Duke Killed By Car Near Whaleyville Lee Byrum, Gates County, Held on Manslaughter and Reckless Driving Charges; Was Walking Near Home. James Walter Duke, 74, was instantly killed at 7:45 last night when struck by an automobile while walking on the Whaleyville highway. In attemptng to pass another car going toward Suffolk, the machine driven by Lee Byrum, aged 21, of near Sunbury, evidently struck Mr. Duke. The car ran into the ditch and over-turned. Byrum was injured and was taken to Whaleyville in a passing automobile for medical care. Shortly afterwards, the neighborhood became aware that Mr. Duke was missing. A search at the scene of the accident revealed the body of the prominent Nansemond County farmer in the ditch by the side of the road dead, his skull fractured. Sheriff Rawls investigated the accident, and went to Whaleyville, where he placed Byrum under arrest on charges of manslaughter and reckless driving. Mr. Duke, who lived about a quarter of a mile from the home of his daughter, was shown by evidence to have been walking on the left side of the road, facing the oncoming traffic, which is the lawful side for pedestrians. He was born on the place where he resided, near Liberty Spring, and had made his home there all his life. Besides his daughter, he is survived by his wife, Mrs. Rosa Duke, and four grandchildren, Mrs. Wesley Byrd, James and Clyde Powell and Miss Susie Powell, all of Nansemond County. He was the son of Nelson Duke and had been a member of Liberty Spring Christian Church for more than half a century. Funeral services will be held at Liberty Spring Christian church tomorrow afternoon at 3 o'clock. The Rev. I.W. Johnson, pastor of the church, will officiate.
