Will Book 3 (1881 - 1885), pp. 352-53 [margin notes] Jas. M. McClenny's Will. I, James M. McClenny, of the County of Nansemond & State of Virginia, being of sound mind & memory, but considering the uncertainty of my earthly existence, do make, constitute & ordain this to be my last will & testament in manner & form following: Item 1st. I give to my beloved wife Mary E. McClenny the following property, which belonged to her at our marriage to wit^: three hundred dollars in money & the interest on it for five years, and one bed & furniture, one sideboard, one wash stand, bowl & pitcher, one set of china, half dozen silver tea spoons, one black tin coffee pot, brass kettle, one table, three chairs & one chest, & one lounge to her & her heirs forever. Item 2nd. I loan to my wife Mary E. McClenny my farm on which I now live, together with the balance of my property of every description except one bed & furniture, which I give to my son, John D. McClenny, at my death. Item 3rd. If my wife chooses to sell at my death all the property that I have loaned her except my land, & take a child's part in fee-simple, it is my will that she should do so. Item 4th. At the death of my wife I give my farm which I loaned to her during her life, to my son Robert E. McClenny, and my daughter Judith C. Ashburn, to be equally divided between them, to them & their heirs forever. Item 5th. If my wife should choose to sell the chattel property that I have loaned to her & take a child's part in fee-simple, it is my will that the balance of the proceeds together with any money that I may have at my death, after paying the amount already devised to my wife & after paying all my just debts & burial expenses & my obligations for church & missionary purposes, shall, after giving to my son Thomas A. McClenny, one dollar, be equally divided between my other four children, viz. Judith C. Ashburn, James A. McClenny, John C. [sic; D.] McClenny & Robert E. McClenny, to them & their heirs forever. And lastly, I leave my wife Mary E. McClenny, & my son James A. McClenny, Executors of this my last will & testament, & from the confidence I have in them I hope the Court will allow them to qualify without giving security. In witness whereof I hereto set my hand & affix my seal this 8th: day of October, 1881. James M. McClenny. Signed, sealed, published & declared in the presence of James M. McClenny, & at his request we have subscribed our names as witnesses. R.R. Owens. Samuel H. Simons. Herschel V. Persons. At a Monthly Court held for Nansemond County, the 14th day of November, 1881. This Last Will and Testament of James M. McClenny, late of this County, deceased, was this day fully proved by the oaths of R.R. Owens and Samuel H. Simons, two of the subscribing witnesses thereto, and was thereupon ordered to be recorded. And on the motion of Mary E. McClenny, the Executrix, and James A. McClenny, the Executor, named in the said will, who made oath as the law directs and entered into a bond in the penalty of Twenty-five hundred dollars, conditioned according to law, (but without security, the will directing that none should be required of them, and which said bond being acknowledged by the obligors therein, is ordered to be recorded) Certificate is granted the said Mary E. McClenny and James A.
