DEED: Francis Campbell, 1842 Deed of Trust SOURCE: Nelson County Deed Book 10, page 77 CONTRIBUTOR: Sylvia Ray ------------------------------------------------------ This Indenture made and entered into this fifth day of August in the year of our Lord, one thousand eight hundred and forty two, between Francis Campbell and Nancy his wife, the debtors of the first part, and Samuel Gay Sr. the Trustee of the second part, and Wiatt Jones the creditor of the third part, witnesseth that whereas the said Francis Campbell and Nancy his wife, stands justly indebted to the said Wiatt Jones in the sum of forty five dollars and ninety two cents due by bond bearing date with this Indenture, and bearing interest with this indenture, and for and in consideration of the sum of one dollar of lawful money of this Commonwealth to Samuel Gay Sr. the receipt of which is hereby acknowledged, the said Francis Campbell and Nancy his wife, hath bargained, sold, and by these presents doth hereby grant, bargain, sell, deliver, and confirm unto the said Wiatt Jones, his heirs, executors, administrators, or assigns forever, the following property, to wit: all their crop of rye made this year and now in the stacks, all their growing crop of tobacco, all their crops of tobacco, corn, wheat, and rye made in the year 1843, and one gray colt, and they the said Francis Campbell and Nancy his wife, for themselves, their heirs, executors and administrators, or assigns will forever warrant and defend the right and title of the aforesaid property, free from claim or demands of every other person or persons of whatsoever now and forever upon trust, yet nevertheless, upon failure of the payment of the debt and interest aforesaid it shall be lawful, and the said Samuel Gay Sr. hath power and is hereby timely empowered to take the property aforesaid in possession and after having fixed the time and place of sale, and give ten days notice at some publick place in the neighborhood of the said Francis Campbell and Nancy his wife, sell at the highest bidder for ready money the property aforesaid, or as much as will be sufficient to satisfy and pay the debt and interest as aforesaid and all the cost of carrying this Indenture into effect, and the balance if any, return to the said Francis Campbell and Nancy his wife, or their legal representations. Now if the said Francis Campbell and Nancy his wife, shall, will, and truly pay unto the said Wiatt Jones the sun of forty five dollars and ninety two cents, on or before the first day of January 1843 with legal interest thereon, and the costs of this Indenture, so that no default of payment, then this Indenture to be void, or else to remain in full force and virtue.
