DEED OF TRUST: FRANCIS J. CAMPBELL TO JONES & CO. SOURCE: Nelson County Deed Book 10, Page 129 CONTRIBUTOR: Sylvia Ray -------------------------------------------------------- This Indenture made the 6th day of October 1842 between Francis J. Campbell, the debtor, of the County of Nelson and State of Virginia of the first part, Joseph M. Tompkins of said County and State of the second part, and Robert C. Jones and Jones and Clarkson, and Robert C. Jones & Co., the creditors, of the third part; witnesseth that the said Francis J. Campbell in order to secure the payment of the following debts due by bond, the first bond due Robert C. Jones for twelve dollars and eighty cents due 1st March 1840, and a bond due Jones and Clarkson for seventy two dollars and thirty eight cents due 1st September 1842, and a bond due Robert C. Jones & Co. for twenty nine dollars and twenty seven cents due 1st September 1842, and in consideration of the sum of one dollar to him in hand paid by the said Joseph M. Tompkins, before the insealing and delivery of these presents the receipt whereof is hereby acknowledged he, the said Francis J. Campbell hath granted, bargained and sold and by these presents grant, bargain, sell, and deliver unto the said Joseph M. Tompkins, his heirs and assigns forever, the following property to wit: all the right, title and interest which the said Francis J. Campbell has or at any time may have both at law and equity, real/personal or otherwise, in the estate of his father and mother, which is in trust heretofore, one bay horse, saddle and bridle, household and kitchen furniture, plantation utensils, and all the estate, right and title, interest, trust, property, claim and demand at law and in equity of him the said Francis J. Campbell, to have and to hold the said property herein before mentioned to be hereby granted unto the said Joseph M. Tompkins, his heirs and assigns forever. Upon trust nevertheless that the said Joseph M. Tompkins shall after the 1st day of November 1844 upon the default of the payment of the within mentioned debts and interest shall as soon as conveniently he can, after having advertised the time and the place of the sale ten days near the residence of the said Francis J. Campbell, then proceed to sell the same for ready money to the highest bidder for the best price that can be obtained and out of the monies arising from the sale, in the first place to pay and satisfy all reasonable charges attending the same and then the debts as they are named and the interest thereon and the balance of the money arising from such sale as aforesaid to the use of the said Francis J. Campbell, his heirs, executors, or assigns, or to such person or persons as he by writing under his hand and seal shall appoint, and in default of such appointment to such person or persons as would be thereto entitled by virtue of the statute for the distribution of intestates estate.
