DEED: Francis J. Campbell Deed of Trust SOURCE: Nelson County Deed Book 14, Page 447 CONTRIBUTOR: Sylvia Ray --------------------------------------------------------------- This Deed made this 4th day of April 1856 between Francis J. Campbell of the first part, Thomas S. Fitzpatrick and Charles N. Patterson of the second part, and James S. Penn of the third part, witnesseth that the said Francis J. Campbell in order to secure the payment of the following bonds to the said James S. Penn, to wit: a note payable the 1st day of January next for the sum of one hundred and fifty dollars bearing date the 28th day of March 1856, bearing interest from the date, and another note payable the 1st day of January 1858, for the sum of one hundred and thirty nine dollars and five cents, with interest from the date, and dated the 28th day of March 1856, and for and in consideration of the further sum of one dollar to him in hand paid by the said Fitzpatrick and Patterson, the said Francis J. Campbell has this day granted, bargained and sold and by these presents doth grant, bargain and sell to the said Fitzpatrick and Patterson the following property to wit: One dark bay mare, twelve hogs and increase, three beds, bedsteads and furniture, one folding table, one small table, one safe, one bureau, seven chairs, and all other house and kitchen furniture and plantation tools, also his interest in the trust estate of or belonging to Nancy Campbell (wife of Francis) the same being for the benefit of her and her children, and the said Francis J. being one of them, to have and to hold to them and their heirs forever, upon trust nevertheless, and upon this consideration that in case the said Francis J. Campbell shall fail to pay the debts on bonds aforesaid as they respectively become due, with the interest, it shall be lawful for the said Fitzpatrick and Patterson or either of them, at any time after the 1st day of January 1857 and after the 1st day of January 1858, the periods at which the bonds aforesaid will be due, having advertised the time and place of sale at least ten days at some public place in the neighborhood of the said F. J. Campbell, sell to the highest bidder for cash the whole of said property together with the interest of the said F. J. Campbell in the trust estate aforesaid or so much thereof as shall be necessary to satisfy and pay the amount due upon the bond or bonds at the time of making said sale together with the cost attending the recording of this deed and making such sale, and any balance remaining in their hands, pay over to the said Francis J.
